Fosamax Femur Fracture Federal Court MDL Lawsuits Are Dismissed For a Second Time in March 2022

In a Long-Awaited Opinion, Federal Court Judge Wolfson Rules in Favor of Merck on Federal Preemption Legal Issue

On March 23, 2022, the federal court product liability lawsuits filed on behalf of women who used Fosamax and suffered femur fractures were dismissed by means of an opinion issued by Judge Freda Wolfson. These Fosamax femur fracture lawsuits had been remanded to the District of New Jersey in late 2019 by the U.S. Court of Appeals for the Third Circuit.  That happened after and because the U.S. Supreme Court made a ruling on the federal preemption legal issue in these Fosamax cases in May 2019 (see Merck Sharp & Dohme Corp. v. Doris Albrecht, et al.). As such, the parties to these federal court Fosamax lawsuits had been waiting for this "new" federal preemption ruling by Judge Wolfson for more than two years.

For some analysis of this March 23, 2022 Opinion for the federal court Fosamax MDL lawsuits — captioned In Re Fosamax (Alendronate Sodium) Products Liability Litigation — we turn to this New Jersey Law Journal article, "Ending a 14-Year Battle, Merck Wins Dismissal of Suits Linking Fosamax to Fractured Femurs", by veteran legal reporter Charles Toutant:

The ruling brings an end to roughly 500 suits in litigation that has been ongoing since 2008 and has made a stop at the U.S. Supreme Court. After a ruling in 2013 by the late Judge Joel Pisano that the plaintiff’s failure-to-warn claims were pre-empted by federal law, the U.S. Court of Appeals for the Third Circuit vacated that ruling, finding that preemption should be decided by a jury. Merck then petitioned for certiorari, which was granted by the Supreme Court. In its 2019 decision, the Supreme Court vacated the Third Circuit ruling, finding that the preemption question should be decided by a judge, not a jury. The case landed back at the District Court, which was tasked with deciding if communications between Merck and the FDA were sufficient to give rise to preemption….

On remand, Wolfson said, the question before the court was whether the FDA’s response to Merck’s proposed warning language “prohibited Merck from adding any and all warnings to the drug label that would satisfy state law.”

Merck asserts that federal law preempts the plaintiffs’ state law failure-to-warn claims, citing the FDA’s 2019 communication, rejecting a warning about femoral fractures. Plaintiffs, for their part, asserted that the 2019 FDA communication is not “clear evidence” that the FDA would have approved any and all warnings.

Wolfson said that, as worded, the 2019 FDA communication “gives rise to competing inferences with respect to why the FDA rejected defendant’s wording.” But when viewed along with other FDA correspondence, it “rejected defendant’s precautions warning because the FDA doubted the evidence linking biophosphonate use to atypical femoral fractures in a causal sense,” she wrote.

… Because the FDA rejected the warning due to insufficient evidence of a causal link between Fosamax and femur fractures, the evidence is clear and convincing that the FDA would not have approved a differently worded [warning], no matter how Merck submitted it. The plaintiffs’ state-law failure-to-warn claims are therefore preempted, Wolfson said.

To possibly assist in understanding the above reporting, we point out that after Judge Joel Pisano retired from the District of New Jersey federal court, the federal court Fosamax MDL lawsuits were reassigned to Judge Freda Wolfson.

As regards the women who used Fosamax and suffered femur fractures, their Fosamax lawsuits have been dismissed a second time, now, again as a result of the federal preemption legal defense. For some of those women this will be adding insult to injury, so to speak.

    Easy for some judge to say if they were not one of the ones who suffered a femur fracture as a result of taking Merck’s Fosamax (alendronate). I am one of those women who was duped into taking this drug for 15 years thinking I was preventing bad things happening to my body as I aged. I, in fact, suffered a fracture in both the left and right femur for no apparent reason other than I took Fosamax/alendronate. I will go to my grave believing that the unexpected fractures were a result of my taking this drug and that the resulting problems I have endured in my knees, back and feet and throughout my entire body can be attributed to same. To say it ruined my life is putting it mildly. Thank you Merck, FDA, Supreme Court, Judge Joel Pisano and Judge Freda Wolfson for nothing.

    I also would like to thank the judge for her decision. I was duped into this worst drug of all time. My surgery report tells and explains how it was the drug that caused the damage–NO MISTAKE ABOUT IT. Merck knew all about what would happen when they claimed “after a few years on the drug, a vacation from it is needed”. That is when mine broke. I have so many stories from men and women who took it and now are damaged. Perhaps now is the time to write my best seller on Big Pharma–and get Fox news involved.
    Let’s hope we do not find out Judge Freda was PAID OFF. In my world if you hurt someone, you have to pay. Merck is a sorry, sorry Company–hiding behind a female Judge’s robes. Yes, a nice tell all book is just the ticket. I believe my Doctor will go on the cover. He stated to me that he lost many patients because he was brave enough to speak out. Let us not forget Merck is still selling Fosomax, ruining lives, and making BILLIONS a year.

    My mother is also a victim of Fosamax. Going through countless surgeries on her left and right femurs. She was only 36 years old(2005) when the fractures started. Her last surgery was in 2021. I hope another attorney could reopen this case because we will not stop until justice is served. My mother is very upset and if anyone could reach out for help that would be much appreciated.

    My sister is, at this moment, in the ER waiting for her second surgery in less than a year for a femur brake. Last June is was her right femur, tonite her left. Clean brakes on both of them, just as many others. She was on Fosamax for five years. Surgeon from last surgery said this break was a Fosamax Break. How can this not be taken seriously by the courts?

    My sister is, at this moment, in the ER waiting for her second surgery in less than a year for a femur brake. Last June is was her right femur, tonite her left.     I have recently taken it for a year. I have a compression fracture that’s why I was put on it. I was in so much pain for the last year…..in my lumbar spine that I almost had to go on disability. I had numerous epidurals, nerve blocks, etc and nothing worked. Finally, I stopped that medication and my pain has gotten so much better! That medicine is the devil! I’m only 43 and shouldn’t be stuck in bed! Never again will I take that.

    I also had my right femur broke on 11/2020 and have had 4 surgeries on that femur, all because taking the Fosamax medication supposedly to help my bones get stronger and took it over 10 years, I also had surgery on my left femur because it showed a hair fracture starting so doctor recommended to do it before it broke, also during that time I fell because I didn’t had enough balance and broke my acromion in my left shoulder, we are in 8/2022 and still just sitting on my recliner recuperating from my last femur surgery in 5/2022, I hope someone can help all of us and go against this company, sure judge hasn’t had any of these fractures that’s why the casa was dismissed, again if there’s an attorney out there that can help all of us contact me please

    My mother was prescribed Fosamax by her doctor back in the 90s. She took it for about 12 years. She passed away two years ago just before her 80th birthday. The last ten years of her life were herendous due to numerous fractures including atypical femur fractures. My mom suffered for so many years from fractures, surgeries, rehabbing. She ended up in a nursing home the last three years of her life. She and I both developed thyroid cancer I’m sure from all the radiation from xrays we were exposed to. I would be present during many of her X-rays to help ease her pain. I am haunted by her suffering. I can still hear her screaming in pain from all she went through. A head orthopedic doctor once told me he had never seen bones as brittle as my moms. I know her condition was caused from taking Fosamax for all those years. She was never told to take a break from it after five years. Why is that bring told to patients now? To prevent whet happened to my mom, that’s why! The femur is the hardest bone in the body. It shouldn’t break from just standing up from sitting in a chair or stepping into a shower, both of which happened to my mom. The judge making this decision should be ashamed of her decision.     Oh, I feel your pain! Sixty-four years old and have had 66 surgeries! Yes, I had to leave my job that I loved due to frequent fractures, surgeries and, yes, chronic pain!
    I have a long history of osteoporosis and was put on Fosamax at a fairly young age. Was delighted when Boniva became available as this was once a week as opposed to daily! Then Reclast – woohoo! Once a YEAR IV infusion! Well I only got this one for a few years before the scariest and MOST painful occurrence happened-yes, I was walking with my husband on our sidewalk when I heard this dreadful snap and hit the cement!
    I immediately noticed my left femur bone fractured with the bottom portion poking out on one side and the top on the other! I grabbed both sides and held pressure as I screamed at my husband “call 9-1-1!” Long story shorter, Orthopedic trauma surgeon came into the pre-op area and first words, “how long have you been on Fosamax?” I explained that I was currently on Reclast. He reported, “you, my dear are done with those medications as you have what we call the Fosamax femur fracture!” He told me that the fracture is atypical and occurs exactly like and looks identical to my fracture!
    A decade later I can report more than a dozen fractures (most requiring surgical intervention), bilateral knee replacements, eight spine surgeries with literally, a cage in my spine, frequent falls due to unsteady gait, neuropathy, drop feet, weakness and significant loss of muscle tone.
    So, no evidence linking biophosphonate use and femur fractures? Well let me give you just an hour or two of homework Judge – please google Orthopedic Trauma Surgeons and pick a handful or two. Give them a phone call (any who “suit your fancy”) and ask the EXPERTS one question, “can you identify via plain old x-ray if a femur fracture occurred from biophosphonate use?” If for no other reason, I would love to see you a bit more educated!
    Please know this is way more than just “casual”. To say it has ruined my life doesn’t seem to fit. It has truly taken from me the life I loved living. I cannot carry my grand babies, I cannot work at a Job I dreamed about since age 5, I cannot garden, I cannot walk my dogs, I cannot hike, I cannot ride my bike, I cannot, I cannot and I cannot! I do NOT want to see anyone go through this again! And yes, SHAME ON YOU MERCK!

    I take Fosamax and have for 10 years. I had no idea I had severe Osteoporosis. When I moved to Waco, Texas, and my new doctor discovered I had a complete Hysterectomy at the age of 24 and given no hormones, he did a full work up on me. This included a bone density test – something I had never had. He said my bones were ‘see-through’ and he had no idea how I was even standing. For two years he had me inject Forteo and then he put me on Fosamax. I had no idea why 5-6 years later when my bones were a little bit better, they were so easily broken. Bones like my wrist, fingers, toes and then suddenly my HIP! The first doctor who was supposed to repair my hip broke my pelvis during surgery. An Emergency Orthopedic surgeon was called in to save my life. I woke up in ICU and received 4 bags of blood before being sent home on bed rest for 6 months until my pelvis healed and then returned to the hospital to have total hip replacement. It was a nightmare. Healing was a nightmare. 3 years later I cracked my pelvis because I turned around too quickly so I fell to the floor in agony. No surgery, but there was a hospital stay and another 2 bags of blood. I have breakages, spinal problems, neck problems and cracks all over the place. I had no idea until now that the medication I was taking to help my bones was most likely the enemy. Now, because I take Fosamax, I have to go to an Oral Surgeon to have a jaw tooth removed. He is hoping there will be no jaw bone breakage and bone loss – another type of Osteo-something. I have possible TMJ as well, which causes another problem. To have oral surgery with this hanging over my head is awful. THANK YOU TOPAMAX! To say I am scared is putting it mildly. If I could sue Merck I would. It looks like the Drug Company, Merck, the FDA, the Supreme Court Judges -Judge Joel Pisano and Judge Freda Wolfson, has made up their mind that women are complaining for nothing. Well, they ALL need a big fat taste of broken thighs, broken hips, broken femurs, broken backs, broken necks and a cracked or broken anything else anywhere on their body that is usable to them. THEN, they need to discover that there is NO help for them – NONE! They will have to live in agony FOREVER. Do you think that would change their mind? It is Doubtful! They would sit on their high horse, pain and all and falsely judge all of us who rightly deserve justice. MAY ALMIGHTY GOD BE WITH US ALL!

To have oral surgery with this hanging over my head is awful. THANK YOU TOPAMAX! To say I am scared is putting it mildly. If I could sue Merck I would. It looks like the Drug Company, Merck, the FDA, the Supreme Court Judges -Judge Joel Pisano and Judge Freda Wolfson, has made up their mind that women are complaining for nothing. Well, they ALL need a big fat taste of broken thighs, broken hips, broken femurs, broken backs, broken necks and a cracked or broken anything else anywhere on their body that is usable to them. THEN, they need to discover that there is NO help for them – NONE! They will have to live in agony FOREVER. Do you think that would change their mind? It is Doubtful! They would sit on their high horse, pain and all and falsely judge all of us who rightly deserve justice. MAY ALMIGHTY GOD BE WITH US ALL!

    Femur fracture surgery September 1,2022. First thing my orthopedic doctor asked me if I was on Fosamax and how long? Now , move ahead 5 months and I am now scheduled with an orthopedic trauma surgeon to repair the same femur because the rod is bending. I had major lower lumbar surgery in 2020, with 5 broken vertebrae and 2 slipped disc. I was only 64, I lost my job, after 31 years, because they couldn’t not accommodate my ADA requests at 3 months post surgery. My quality of life is awful. I can’t work, I can’t do housework, can’t cook much, can’t garden, can’t go on family outings, can’t take a shower very well, hurts to drive( before fractures, intimacy has been affected. I’m on meds for depression and anxiety. I hope that if a lawsuit comes up again, I can give my contribution to any needed information.

    Just diagnosed with atypical fractures in both femurs. Scheduled for surgery this week with a trauma surgeon.. The radiologist report reads findings compatible with bisphosphonate related stress reactions in bilateral mid femoral shafts. I have been on and off Fosomax for 20 years. I was warned years ago it could affect the jaw but no one ever said it would cause fractures of the femur! Why are they not at the very least screening women who are on it!

    I agree to you Linda Smith.Like you I also suffered femoral fracture left and right for no apparent reason
    too than I took this fosamax/boniva.It destroyed my life,
    my future.Bec of the pain,suffering and inability to do what my job requires,I was forced to file for early retirement/disability.I lost so much since I can’t cope up
    with my financial needs.We have to suffer all this consequences and you are right easy for Merck,FDA
    Supreme Court,Judges Pisano and Wolfson.
    coz they didn’t endure the suffering we did.
    We’ll just take it to our grave.

    Why can’t we go after the FDA then? Why isn’t someone responsible for not telling us this? My mom was just walking and her femur bone just snapped! She was never right after that, wheelchair, canes etc until she passed away 3 yrs after that. This was yrs ago but before she died she was fighting this case & told me not to stop fighting it for her.nit was unfair!

    My left femur broke -clean brake in Jan 31 ,2023 Emergency surgery same date repaired with rod and screws by a wonderful Vanderbilt Doctor.-now in my 9th month of rehab . Have appt 11-29-23.So far , I have met 3 out of 4 requirements ,hopefully the 4th requirement will be with my upcoming appt.. My Doctor was very pleased.with 3 out of 4 . My Sugical diagnosis was Typical femur fracture due to the drug Fosomax . Before this ,I had my
    6 months and yearly check ups (blood work and bone density test yearly ),Was told to continue with taking my meds which one of them was Fosomax (had been taking Fosomax since early 2000 ‘s ) . This has been a nightmare , someone is responsible ,I was just the patient doing exactly what my PCP Doctor said to do ,thinking I was making my bones stronger . Please heip !

    Agree 100%. I have the same experiences as you had. I broke both of my femurs because I took Forsamax for 10 years believing that Forsamax prevented me from osteoporosis.On the contrary I suffer fermoral fractures on both thighs without any hard fall. Thanks to Merck and Supreme Court Judges that value profit more than human lives.
