On July 23, 2007 Merck & Co. announced the following information about the Vioxx product liability litigation, as taken from the drug company’s press release entitled "Merck Reports Double-Digit Earnings-Per-Share Growth for Second Quarter 2007":

As of June 30, the Company had been served or was aware that it had been named as a defendant in approximately 26,950 lawsuits, which include approximately 45,225 plaintiff groups alleging personal injuries resulting from the use of VIOXX….

Of these lawsuits, approximately 8,575 lawsuits representing approximately 23,450 plaintiff groups are or are slated to be in the federal MDL [i.e., multidistrict litigation in the U.S. District Court for the Eastern District of Louisiana] and approximately 16,400 lawsuits representing approximately 16,400 plaintiff groups are included in a coordinated proceeding in New Jersey Superior Court.

In addition… the claims of more than 4,620 plaintiff groups have been dismissed as of June 30.  Of these, there have been more than 1,170 plaintiff groups whose claims were dismissed with prejudice (i.e., they cannot be brought again) either by plaintiffs themselves or by the courts.  More than 3,450 additional plaintiff groups have had their claims dismissed without prejudice (i.e., they can be brought again).

Interestingly, while this July 2007 Merck press release stated that the drug company had increased its reserve fund intended "solely for its future legal defense costs" related to the Vioxx personal injury cases and other components of the overall Vioxx litigation, e.g., economic loss and shareholder lawsuits, it went on to say that the drug company "has not established any reserves for any potential liability" related to any aspect of the Vioxx litigation.

Here is Merck’s list of scheduled Vioxx trial dates as of July 20, 2007 for Vioxx personal injury lawsuits filed across the United States:

  1. Appell / Arrigale, California Superior Court, Los Angeles County, September 17, 2007;
  2. Kozic, Florida Circuit Court, Hillsborough County, September 17, 2007;
  3. Crandall, Nevada District Court, Washoe County, October 1, 2007;
  4. NJ Coordinated (Four trials with up to 2-3 plaintiffs each), Superior Court, Atlantic County, October 15, 2007;
  5. Zajicek, Texas District Court, Jackson County, October 22, 2007;
  6. Donohoo, Illinois Circuit Court, Madison County, October 29, 2007;
  7. CA Coordinated (Trial of up to 5 plaintiffs), California Superior Court, Los Angeles County, November 26, 2007;
  8. Turner, Alabama Circuit Court, Bullock County, January 7, 2008;
  9. Frederick, Alabama Circuit Court, Jefferson County, March 10, 2008;
  10. Singleton, Florida Circuit Court, Gasden County, April 7, 2008; and,
  11. King, Illinois Circuit Court, Madison County, April 14, 2008.

One will notice that as of July 20, 2007 there are no Vioxx cases with trial dates set in the federal court MDL, according to Merck, despite the fact that there are reportedly "approximately 8,575 lawsuits representing approximately 23,450 plaintiff groups" currently in the Vioxx MDL.  Of course this situation as well as the Vioxx trial dates listed above are subject to change as things go forward.

P.S.  By means of a July 26, 2007 press release from Merck & Co. about Kenneth C. Frazier we first learned that Mr. Frazier will no longer be the company’s General Counsel, effective August 1, 2007, at which time he becomes President of Merck’s Global Human Health division.  In turn, Bruce N. Kuhlik has been appointed to the Merck General Counsel position.

Mr. Frazier served as Merck’s General Counsel since 1999.  In that capacity, Mr. Frazier has been largely responsible for the company’s Vioxx litigation strategy to date, as reported previously on this site in such articles as Merck Has No Plans for a Global Settlement Says General Counsel Frazier.

According to the Merck press release Mr. Frazier will work with his successor, Mr. Kuhlik, on the company’s Vioxx litigation. One must wonder, however, if this change at the helm might foreshadow a different approach by Merck to the Vioxx litigation going forward.  (7/26/07)

    I have just found this site and glad I did. What if any information you have on oxycontin and puerdi pharma? I was addicted to oxycontin for ten years and finally went through hell to get off it. I filed a law suit with James socolove law office and they7 turned my case over to Simmons law firm. I have had nothing but trouble and heartache with the people at Simmons. I have serous heath problem that oxycontin helped the pain. I did not know I was addicted until all the information about the drug came out. I thought my that my medical problem was just getting worse and in time it will.
    i have asked to be compansated for my pain and suffering. I told the lawyers that I did not want to be put in a class action suit, I wanted my case to go before a judge on its own merits. Simmons went ahead and put me with another thousand people, many were atmitted drug attics and are still abusing oxycontin. Some admitted they used oxycontin to get high. When these thousand people were put togather in what Simmons called (tolling agreement) which in another word for class action. I feel that I should recieve a substantial amount for what I went through with this killer drug. I was told that I would recieve 38,000 for my share. Some of the people recieved over 200,000 because they had a court date set. Simmons sat on my case for four years and I never got a court date so therefore I did not get the big money. I am sixty years old and live alone on six hundred a month social security, I have no car and live in a house that is not fit to kive in. I was counting on that money to buy a new mobile home and a drivable vehicle. Due to attorney screw up I lost my fight. If you would tell other people who have been victomized by big drug companies and an unprofessional law firm that does not even know what they are doing and are only worried about how much money they are going to get out of their cliants to go to another (good) law firm and to fight for their rights as a victom.     Unfortunately we do not have any information on this site about OxyContin nor the recent products liability litigation concerning this prescription drug.
    I am sorry to hear about your apparent less-than-satisfactory experience as regards the handling of your OxyContin claim.
    My law firm represents people who have experienced serious side effects from their use of certain unsafe prescription drugs. We file an individual lawsuit for each of our clients, and do not put them into class actions.

    my wifes vioxx lawsuit was filed in dec.03 to be heard in state court,then was shifted to federal court.IT Appears merck has a winning stratgey as the majority of plaintifs will be dead before their cases are ever heard Its a shame our court system will not stand up for the people.MY WIFE HAS SUFFERED TWO HEART ATTACKS AT THE HANDS OF BIG PHARMA AND WILL PROBABLY NEVER GET A CENT FOR HER SUFFERING.SHOULD WE BE SURPRIZED, I DONT THINK SO

    Your frustration about the delay getting your wife’s case into the courtroom is understandable.
    During the past week to ten days it has been reported that the next round of trials in the federal court Vioxx MDL will involve people who suffered strokes after using Vioxx. I understand that this news will not make you any more “optimistic”, but I wanted you to know what the latest word is as regards the Vioxx cases that are part of this federal court MDL.

    My Dad was 58 NEVER DRINK NEVER SMOKE and Took VIOXX die of Heart Attack in 03. What is the likely hood that Merck will Start settleing. I hope not, We would love Our Case be judge on the merits and not to have the lawyer make all the money.

    Merck has not said that it will change its Vioxx litigation strategy of taking each case to trial, but as a practical matter that approach seems impossible. As such, it is expected that at some future time there will be a settlement plan put in place by Merck to pay compensation to those people who can establish that they used Vioxx and then suffered a heart attack or ischemic stroke as a result of their Vioxx use.
    We will keep you posted on any newsworthy developments as regards the possibility of there being Vioxx settlements by Merck going forward.

    i had a stroke in 2001 and out of work for the rest of my life.i lost my home., car.,trucking company and ever thing else that could go wrong.now its 2008 and nothing.but merk goes on makeing money.im 65 now and hopeing for my day in court. ever one is makeing money but the ones who had a stroke or heat problem by takeing vioxx.whats wrong

    The news about your apparent Vioxx-related stroke and Merck’s failure to pay you any compensation after all this time is disturbing.
    Hopefully Merck will settle the legitimate Vioxx claims sometime in the near future, which is the only fair thing for those many unfortunate situations like yours.

    Coincidentally, an August 21, 2007 article by New York Times (NYT) reporter Alex Berenson originally titled , “Plaintiffs Find Payday Elusive in Vioxx Cases”, was picked up by the Associated Press this week and published in many different newpapers around the country. Accordingly, a lot of people got some insight into Merck’s strategy for the Vioxx litigation.

    My husbnad had a heart attack from taking vioxx, he took it 18 months, and had to have stendts put in. He did have prior heart problems, but never had a heart attack, and a few months prior to the heart attack, he had just had some tests, and got a clean bill of health. Its been over three years now, and we are getting discouraged because we don’t see any end in site. Our attorneys are very optimistic, but I wanted your oppinion about this as well. Do you think in the next year or so we will see a global settlement? they can’t go on like this, because it’s true…we will all be dead at the rate they are going. Please advise.

    My sense is that Merck will continue to scrutinize all filed Vioxx cases to ensure that the claimaint actually took Vioxx leading up to the time of their heart attack or stroke. Eventually, I believe, Merck will establish a settlement scheme for those cases where Vioxx use is established. Based on trial results up until that time, certain pre-existing medical conditions may be identified that will cause a case’s value to be reduced, and the claimant’s age at the time of their cardiac event will no doubt be a factor. When Merck will establish this settlement plan is a tough call. Taking into account the 2008 Vioxx trial plans of Judge Higbee in New Jersey and Judge Fallon in the federal court MDL, I predict that Merck will not start settling valid Vioxx cases until the end of 2008 at the earliest. Of course, that is just my guess.

    My father started taking vioxx in 2001. Then on June 21, 2001 he had his first heart attack, then on June 21, 2002 (exactly one year to date from his first heart attack) he had his second heart attack which he ultimately died from. We have a lawsuit against Merck through my father’s estate and cannot close the estate until the lawsuit is settled. Why are they not trying cases where people have, like my father, been taking vioxx less than 5 months and have a heart attack, and also longer than 18 months and have a heart attack? Wouldn’t that change the way and timely manner that Merck would start settling cases? I am in no way making light of the cases that have already gone before the courts, I just think stronger tactics should be used in the beginning to set precedents. Who decides what cases are heard, and in what order? Why are any of the lawsuits being heard in the same state that Merck is based out of? Couldn’t that be considered a conflict of intrest? Merck has disgrased the United States people along with all the Pharmacutical companies. We are not a third world country, nor do we practice medicine from the 1800’s. To let a large amount of innocent people die from their product, or mass amounts of innocent people be injured from their product,(just to make more money, without regard for life itself), could be perceived as a mass murderer, or even a terrorist act. If it were not for the people who have vested interest in the company and those in charge (with MONEY). I am sure it would be. If I distributed a product that killed or injured even just one person I would be in jail, forget just paying a settlement, I would go straight to jail.

    I understand your frustration with the legal process as regards the Vioxx litigation thus far.
    The Vioxx lawsuits are, for the most part, either filed in NJ state court system, where Merck is headquartered, or in the federal court system and all of those federal cases have been transferred to New Orleans as part of the Vioxx MDL.
    Hopefully there will be more cases that make it to trial in 2008. The cases that go to trial next year will be selected by the presiding judges in NJ (Higbee) and the MDL (Fallon), with some input from various lawyers for the plaintiffs / victims and certain lawyers for Merck.
    I hope this gives you some of the explanation and information that you were looking for….

    my mother died in 03 after taking vioxx for 18 months i will more than likley die before her case goes to trial because of this legal system that we have. and it is ashame that merck sits up their like a fat cat. like nothing ever happend they make me sick. hope that they belly-up.

    It seems that after some more trial results in 2008 Merck may have be in a position to figure out how to resolve the claims of people who were injured or died as a result of their Vioxx use.
    Of course, we will monitor and report developments as regards the Vioxx litigation.
