Do You Want To Sign The “FDA Preemption = Bad Medicine” Online Petition?

This Petition Is Sponsored By A Group Of Concerned Citizens Called "Americans for Drug and Device Accountability"

In several earlier posts I have advocated that any application of the federal preemption doctrine to drug injury lawsuits would effectively eliminate a significant incentive for the drug company to ensure that its drug labels reflect accurate and up-to-date safety information, i.e., the possibility of failure-to-warn product liability litigation.

If you tend to agree with this position, you may be interested in signing an online petition titled "FDA Preemption = Bad Medicine".  This petition is sponsored by Americans for Drug and Device Accountability, which describes itself as "a group of concerned citizens interested in protecting the civil rights of the American people".

The online petition form allows you an opportunity to add a Comment along with your signature.  Please know that the voluntary contribution form which pops-up after you click the "Sign Petition" button can be closed and your signature will still be recorded for the petition.  (Of course, you can contribute to the online form company, which is where the money would go, if you want.)

Finally, you should feel free to express your opinion about federal preemption in the context of drug injury cases here by submitting a Comment to this post.

    Tom – Thanks so much for calling attention to our petition. I am one of the group that got it rolling, but we obviously hope others will join in.
    We are not naive. We realize that internet petitions have limits (to say the least). But we view people’s comments, and spreading the word, as important as the number of signatures. Indeed, we view it as _more_ important.
    It may surprise you that our core group genuinely includes people from every poltical persuasion – from conservative Republicans to lefty liberal Dems. We are healtchare professionals, teachers, patient advocates, and even people in the pharma industry. I know (because they’ve told me) that a number of the “anonymous” signers are people from industry.
    So if you can not just sign but express your views, that would be terrific. And, if you have the time, pass it on. Sometimes things really do grow in unexpected ways.
