Sprint Fidelis Lead Wire Defect Litigation Comes To An Apparent Disappointing End (Medtronic Wins)

8100 Pending Lawsuits Get Modest Settlement Payments; Remaining 100,000 Plus U.S. Patients Have No Legal Claim Due To Federal Preemption Ruling

As those who have been following the Sprint Fidelis litigation know by now, the thousands of product liability lawsuits that had been filed in connection with the defective lead wire recall by Medtronic did not go the way that injured plaintiffs had hoped.

Back in January 2009 U.S. District Court Judge Richard Kyle, who was overseeing the federal court Sprint Fidelis MDL — In Re Medtronic Inc. Sprint Fidelis Leads Products Liability Litigation, 08-1905, U.S. District Court, District of Minnesota (Minneapolis) — dismissed all of those personal injury and wrongful death lawsuits based on the U.S. Supreme Court's Riegel v. Medtronic medical device federal preemption doctrine ruling.

We will let reporter Andrew Longstreth take us from that point forward, to the apparent disappointing end — from the patients' perspective, at least – for this Sprint Fidelis litigation.

From his October 18, 2010 article for The American Lawyer, "Medtronic to Pay $268 Million to Settle Defibrillator Suits":

Plaintiffs lawyers promptly appealed Kyle's ruling to the 8th U.S. Circuit Court of Appeals. But Medtronic didn't wait to see if the appellate court would affirm the decision. On Thursday the company announced that it would pay $268 million to resolve Sprint Fidelis-related suits pending in the Minneapolis federal multidistrict litigation, in Minnesota state court and elsewhere throughout the country. The amount includes attorney fees, according to Medtronic.

"The settlement is a compromise of disputed claims, and the parties have not admitted any liability or the validity of any defense in the litigation," said the company in a statement. Spokesperson Christopher Garland told Bloomberg that the deal covers about 8,100 cases, or virtually all pending U.S. claims.

The settlement will provide an average payout of about $33,000 per plaintiff, according to Bloomberg.

Last week, when we reported on Medtronic's $268 million settlement of essentially all pending U.S. claims alleging product liability defects in its Sprint Fidelis defibrillator leads, we noted that the deal came before the 8th U.S. Circuit Court of Appeals ruled on the dismissal of many of those cases on pre-emption grounds. On Friday, that ruling came down. It's the first appellate interpretation of the U.S. Supreme Court's ruling in Riegel v. Medtronic — and it's a home run for fans of federal pre-emption of state law-based product liability claims.  [emphasis added]

For more details, see In re: Medtronic, Inc., Sprint Fidelis Leads Products Liability Litigation,__ F.3d __, 2010 WL 4026802 (8th Cir. Oct. 15, 2010), wherein this federal appellate court agreed with Medtronic that the plaintiffs’ claims were preempted by federal law.

To show why this is such a disappointing conclusion for the Sprint Fidelis patients, we get these rather remarkable numbers from the October 15, 2010 coverage from Bloomberg news reporters Jef Feeley and David Olmos:

About 268,000 patients had the targeted leads at one time, company officials said. They were introduced in 2004, the officials said. The company estimates that 170,000 people worldwide still have defibrillators with the Sprint Fidelis leads inside them.

Putting aside the relatively modest $33,000 average settlement payments to the individuals who had their Sprint Fidelis lawsuits pending prior to the October 2010 settlement by Medtronic, here is the harsh reality for those other 100,000 plus U.S. patients who still have the defective Sprint Fidelis lead wires implanted:  If they ever suffer a series of unnecessary shocks from their defibrillator when it malfunctions, or a person dies when their defibrillator fails to shock due to the defect, there will be no legal compensation coming from Medtronic for the injury or the death.

This sure doesn't seem like the "right" outcome to me.

    I think we just got shitted. I feel that Medtronics know that they are responsible and felt guilty. That’s why they volunteered to give us a token. Now more than ever I am afraid that my leads will fracture. I am just up the creek without a petal. I hope that the lawyers and medtronics can live with their big win, while we try to live period.

    Are you sure this is correct. Word has it that there is going to be money set aside for people that have problems down the road. My source is very good and we don’t need to spread something that is not backed up. I have that back up.

    I presume you are alluding to this concluding statement from my post, above:
    “…there will be no legal compensation coming from Medtronic for the injury or the death.”
    I feel confident that there will be no successful products liability claims filed against Medtronic under current law on the federal preemption doctrine as applied to FDA-approved medical devices.
    At present, I am not aware of any plan for Medtronic to pay compensation outside of the court system for people who are injured or die in the future (or who did not qualify for this recent settlement because they did not have a pending legal claim?), but that is a possibility.
    If you are able to share more of your information, by means of a response here or privately, that would be most appreciated.
    You are correct that I do not want to mislead anyone about the apparent outcome of this Sprint Fidelis litigation, especially given the serious nature of this matter.

    This settlement is ridiculous. I have a Sprint Fidelis Lead still in me right now and I had it inplanted 30 days before the recall. You can not tell me they did not already know this was a big problem before they put this thing in me. The problem with the settlement is there is 3 classes. First class: If you have it implanted but have had no problems (No leads break or shocks) you only get $1,000-$1,500 for them putting a faulty product inside you. One that suppose to save your life may inturn cost you your life. Second class: If you had had some shocks/complications but the lead is not broken you get $30-$35,000. Third class: If you had shocks and also your lead was broken and they had to go in and replace it or you are dead from the broken leads you get $75-85,000. Please keep in mind if you had insurance your settlement first goes to pay the insurance company back and if anything is left which I truly doubt you will get to keep the remaining balance. So most likely very few people who had this faulty product installed will receive little or no money for their pain and suffering. The lawyers made out big while the people who needed the money to cover medical bills got a good screwing. What stops Medtronic from putting out more crappy products in the future knowing that they don’t have any responsiblity for the product to be safe. We have to rely on the FDA? Look where that has gotten us. This whole thing really sucks.

    First of all, thanks for your information concerning the settlement “program”, and giving us your opinion of it.
    Second, I fully understand why someone like you — who got the defective leads put in when Medtronic officials were probably meeting daily to determine the best time to announce their Sprint Fidelis recall (for the defective lead problem they had probably been aware of for some time, as you point out) — is angry, to say the least, now.
    One thing you and other similarly situated individuals may want to do,now, is to let your elected representatives in Congress know that the federal preemption doctrine “protection” given to medical device manufacturers such as Medtronic — which was the driving force behind this sub-par settlement deal — is unfair to patients, and tell them your real-life story as an example.

    Guess you were right in the fact that if you had not filed a suit, you are not eligible for any compensation. Seems the patient has to take some responsibility in the fact they had not followed up with processes and at least filed. I did and 15 months later I had a fracture and was shocked 6 times. Had my lead replaced and set up a blood clot, spent 6 days in the hospital and had to take cumin for 8 months. AS MY GRANDFATHER ALWAYS SAID “BETTER TO BE SAFE THAN SORRY” In this case I am certainly better off safe.

    Tom: I suffered 37 massive, very painful shocks due to my Sprint Fidelis lead fracturing – 2 surgeries later and am now in heart failure thanks to Medtronic’s greed for profits. After Subrogation, I doubt that any of the victims will see a dime – Pre-emption needs to be abolished so this never happens again. Medical manufacturer’s need to be held accountable for the products they produce, particularly Class 111. This settlement is a sham!!!!

    My name is Bob,I live in St.Joseph Mo. and I have known I had one of the recalled leads for about 3yrs. Last week 12-10-10 I was at my cariolagists Dr. Mohan Hindipur,and it was discovered that I have a fracture in my lead now,but instead of doing something about it I have to be seen by a Medtronic Rep first which I think is a bunch of crap,having your health decided by a rep instead of a doctor.

    It is a shame that this country has stooped so low that people lives mean nothing these days.Medtronics has settled but when does the payout start,when the lawyers build up enough interest that makes them feel comfortable,I have had mine replaced because of the shocks delivered by my device.my lawyer sent me a letter back in nov of 2010 saying don’t mention anything to anyone,question:why the secrets what are the hiding from?I say the lawyers need to be open with the people they work for.

    I think the only one’s laughing all the way to the bank is the Medtronics. They got away with putting a defective product that almost killed and ruined my life. The only thing settlement does is leaves Medtronics looking for change in there sofa.

    I want to add that Medtronic has started a warranty claim process for patients. My lead fractured 3 days after the settlement. I was not a part of the lawsuit. I expected if my lead ever fractured that Medtronic would do the right thing for their customers. I received a Check for $3400.00. I was told that was the maximum Reimbursement for unpaid medical expenses that Medtronic’s warranty would cover. Does not seem fair, but I do not think Medtronic cares about fair. They are a MultiBillion Dollar company for a reason. Settlements like this only benefit the lawyers and Medtronic. The people who are injured or who died because of their mistake are the ones who get the bill. Medtronic made money on my new device as well. My total hospital expense was $130,000.00 Medtronic received an additional $69,210.00 from my insurance company just for the new lead and device. Why did I have to pay 19,200.00 for a replacement lead? Was this just another oppertunity for Medtronic to make more money. Let’s do the math. They paid me $3400.00 and charged me $19,200.00. Now multiply that a few 100,000 times. 267 million was pennies on the dollar and an insult to patients. Medtronic can stand protected by the decision but they need to be exposed for what they have really done.

    I rejected the settlement offer of approx.
    600.00 after attorney fees.Future funds only pay insurance or medicare.Its a total
    display of contempt for the people of this country and the power of big business.What
    is 600.00 in 2011? eight tanks of gas???
    It is an INSULT in addition to the crime.
    They knew they had a problem when my icd was implanted . I dont care who approved the leads if their defective medtronic is responsible!!!!!

    Tony, I don’t think you have much of a choice as wither you accept or reject the offer. As I read my papers it tells me that they will make you an offer and if you disagree you have the right to tell the retired judge why you disagree. But he has the final say. And if it ain’t fractured you are not going to get anymore than anyone else whos hasn’t fractured. They state very clearly that they pay for no mental anguish if it hasn’t fractured. I will tell you this, you don’t want it to fracture and get shocked. That is not a good thing, I can vouch for that.

    Well, I finally got some news that my attorneys as well as it seems others have not shared with us. The original Dec. 1,2010 latest sign off on the agreement date was extended to May 2, 2011. That means that 2-3 months after that payment amounts should be agreed upon and payments should start around Sept.-Oct. 2011. I really believe the extension was caused by many people not understanding that they really did not have a choice when it came down to it. And therefore would not sign up for the program. Especially those that were told they would only be getting $600.00. But in actuality if they did not have a fracture, that is about the right amount according to my briefs, after attorney fees. Whatever people get certainly will not be what they deserve, but better than nothing like the Supreme Court said.

    My name is Earl Eubanks,I was driving when I was shocked several times! Now it is 2011 and the case has been settled the lawyers are making all kind of excuses not to pay the plainiffs,they have the money in escrow collecting intrest and using the interest to pay the plainiffs with!last year in november I received a letter stating my laywer needed documents from my doctors by the end of november,that was the deadline,,then my lawyer told me it will be at least 3 months form january for payouts then after 3 months past now they are waiting for the courts for the payouts,these lawyers are nothing but liars and crooks!

    Thanks for your response! My lead fractured March 26, 2010. I coded March 28, had surgery March 29 and was in the hospital until April 3 because they couldn’t get my INR reading up to two because I was taken off of coumadin prior to the surgery. I immediately sent my attorney package back in when received it. I understood the cut off date would be Jan 11. I asked my attorney for an update via email and in his response it was as if how dare you question us… the date has been extended to May and monies probably won’t go out until Winter or later!
    At present the only “souvenir” I have from this lead hell started are the defibrillator pads the nurse gave me after they “brought me back”.

    I was 22 years old when I had first implant. I had just given birth to my son. On July 18, 2007 my lead (6932) fractured and shocked me 14 times. The number would of been lower but the hospital had no idea who to call until my mother told them to call medtronic. Two hours later, the Rep arrived and eventually turned off the defibrillator. I am a single, active, working-mom but now have restrictions and worries because the new lead that was implanted was recalled!! Im 37 years old and have a long life of worrying ahead of me.

    I had a lead that was not on the recall and it fractured in July 2006 tearing a hole in my lung. Never shocked me. The Cardiologist replaced it with the defective lead and it was recalled a few months after they implanted me. I was told by my Cardiologist that if it was going to fracture it would have done so in the first couple of weeks. Now they are going to change my battery and a few other things leaving me to believe they are leaving this defective lead inside of me. There was no justice done for the defective lead that fractured nobody would even take the case without a ridiculous retainer and now I have this time bomb inside of me waiting to go off and who knows what it will do this time. That is my 2 cents worth.

    Tom, I commented above on Dec. 10, 2010. In addition to my lead fracture, 2 surgeries etc in 2008, on May 2, 2011, my new pacermaker/icd went off again – only 3 times on this occasion. However, after the shocking, my pacemaker made a very loud continuous clicking sound. When Medtronic investigated a few hours later while I was in the ER, it was found that I had no voltage left in my pacemaker that was only 2 years old and had recently been checked and was fine. Since I am pacemaker dependent, they had to insert a temporary pacemaker, give me massive doses of Vitamin K, transport me to the Good Samaritan in LA where the following day, had to insert a new pacemaker/icd. 8 days later I was released from the hospital. None of the Doctors nor Medtronic had ever heard of this happening before. It is still being investigated by Medtronic as to the malfunction which wiped out the entire memory and battery. This of course has happened prior to ever receiving any monies from my sprint fidelis lead fracture. The only winners re the settlement, are going to be the Attorneys. What a sad situation and now it has happened again. Do you think my wife and I are willing to go through another lawsuit for a faulty device manufactured by Medtronic? Absolutely not. So, they win again.

    about those letters or whatever it is about these companies wanting to
    represent someone in working with the Medicare reps or whatever…

    Tom, We have still not received any final monies to any case. Several blogs have people stating that the claims now was at over 15000, not 8100 and that the amount was reduced to 220 million. don’t know if this is possible or not. I just know its taking along time. tick tick tick, alot of us may not have a long time left in this old world.

    As I am not involved with the Sprint Fidelis settlement nor am I representing any claimants who filed a lawsuit against Medtronic, I do not know what has happened, if anything, to the original arrangement, i.e., numbers and amount.

    This is the latest news on what is happening in Minnsota and the SPRINT FIDELIS LEAD SETTLEMENT. The lawyers committee is meeting and sorting all the medical papers etc. The SPECIAL COMMITTEE OF AWARD ATTORNEYS will meet when all paperwork is finished from the first committee. They will then put a money figure by each claimant and then JUDGE ROSEBURG will have to approve it. The $268 million was cut by $48 million and is now $220 million. MEDTROIC said they were not enough people so they cut the orginal amount. Also the attorneys will get 40% plus expenses after insurance, medicare or medicade get paid. Then you will get what is left if there is any. It has been a long wait and will probably be next year 2012 before we get any money. 14000 +claimants are involved.

    Tom, there again we have not received any information regarding a decrease in payment or the number of people involved. I may ask how could you sign an agreement, that is publicly know amount and that amount be changed. My attorney has denied this. I am really confused now. Just wondering.

    I DON’T KNOW WHO THIS GUY BOB IS BUT I THINK HE HAS NO KNOWLEDGE OF ANYTHING THAT HAS HAPPENED WITH THE MEDTRONIC SETTLEMENT. THE AGREEMENT I SIGNED AND EVERYONE ELSE WHO IS INVOLVED IN THIS SETTLEMENT SIGHNED THE SAME AGREEMENT AND THEY MEDTRONIC CAN DO ANYTHING THEY WISH AND THEY CUT THE $48 MILLION OFF THE $268 MILLION BECAUSE THEY WERE ONLY 14000+ PEOPLE INVOLVED. I HAVE TWO NEWSLETTERS STATED ALL THIS AND HAVE HAD THIS INFORMATION SINCE THE 1st OF MAY 2011. MEDTRONIC ACTUALLY DOES NOT HAVE TO PUT ANY MONEY IF THEY CHOSE NOT TO. BOB NEEDS TO READ THE SUPREME COURT REGIS VS MEDTRONIC AND HE WILL SEE YOU CAN SUE BECAUSE OF THAT DECISION! BOB NEED A NEW LAWYER OF MAYBE HE IS NOT EVEN INVOLVED IN THIS SETTLEMENT! I simply stated I have not received any of this information and my attorney has assured me nothing has changed. as for the number of recipients, The only number I have is the one the press originally said, about 8100. I will not post again until all is final. I do know what MDSA is and I know Reigel vs Medtronic.

    My device was installed in Aug 2006. I was 30 years old after the birth of my son. I went in last week Aug 2 to have the battery changed and during the procedure my lead Fractured.
    I was never informed about this lead being recalled. I had no idea I had a recall lead.
    The risk was too great last week to remove the bad lead or put a new one in. I now have a new defib device that is not even turned on. I am looking at many dangerous surgeries to remove the fractured lead and implant a new one, not to mention the constant worry that the fractured lead will dislodge or worse yet that I might need my device and it is not turned on…………does anyone know what I can do to get some help?

    As for your medical situation, you should seek guidance from your cardiologist and other physicians familiar with Sprint Fidelis lead wire extraction.
    As for your legal situation, unfortunately, you may be too late to participate in the Sprint Fidelis settlemnt. However, as I am not involved with that settlement nor am I representing any claimants who filed a lawsuit against Medtronic, I may be wrong about that.

    I have just read my mothers paperwork that she received from her attorneys last year regarding this settlement. There are 3 tiers of payment structures and according to the paperwork unless you have a lead fracture you are in the first tier payment and will only receive $1000-2500. Most of the money is set aside for people that have suffered lead fractures or will suffer them in the future. That was my understanding of it. This was the paperwork from her attorneys though. So most people won`t get anything after they pay back insurance or Medicare and take attorney fees. So what will be done with all this money is my question. I would like to hear what other peoples are hearing or their paperwok told them.

    I am a little concerned for a couple of reason about people posting any detailed information on the web site that is related to the settlement. I’m one that is involved in the settlement and have had a few updates but nothing I will or could share on not only this website and forum but any public website or forum according to my attorney. I would ask others that if you are a part of the settlement to please be cautious about sharing any details on this or any public internet site.
    Next I want to say that I do really thank you Tom your website is great for other reasons and helps to spread the word and help others about another critical area of this whole problem with regards to the recalled medtronic leads. I really would like to discuss with you about possibly getting a private forum started to open up the questions and answers to such issues with anyone that has a recalled lead. I agree with you 100% about having the last lady Brooke that posted to please contact her doctors immediately. I would call another cardiologist maybe and/or specifically an electro cardiac doctor that could help her immediately! These are the type post that I could see for the private site. I would like to see the people who have had problems or could have problems with their medtronic leads be able to come to and use the site as one of the resources to help them with questions and opinion on the lead. I know there is a lot of things that should be done for people that have the defective ICD & lead which in my opinion Medtronics is not doing and has not done a very good job of educating everyone and not just the patients, but paramedics, family members, doctors etc. at this point in time to my knowledge. What I can share about mine that (failed) went off in 2008 and shocked me over 28 times before it was deactivated. It surprised me that no one like the paramedics, or even the ER doctors at the hospital in my large metropolitan area knew what was happening, let alone what to do, in my case. It was really sad that it could have been stopped after just a very few shocks by simply putting a magnet on top of the ICD and taping this magnet to my chest until the Medtronic representative could arrive at the hospital to turn it off completely. (This is not medical advise as I am not a physician so please consult a physician or your doctor for advise as this is in no way advise on how to treat your individual case or problem if you have an episode. Please seek medical help and call 911 immediately should you experience any problems or multiple shocks etc) Any way it took several hours to figure it out and the only way that it was figured out what had happened or was happening was that a cardiologist making his Sunday rounds at the hospital heard that a patient had come in to the ER in the hospital (me) with an ICD that had continued to deliver shock therapy and really both ER doctors that were on duty were going back and forth questioning each other if it was something with my heart and the ICD was shocking me like it was normally suppose to do or if it was something else causing the problem. Neither one of the ER doctors knew that a magnet would stop the shocking. I was very fortunate (blessed) to have had a cardiologist that was making rounds on a Sunday afternoon who heard that they had a patient(me) in the ER with my symptoms. I was not a patient of his but just the fact that my symptoms where my ICD was shocking randomly and was almost out of juice was enough for him to come down and evaluate my case. The medtronic representative was on the way but had to come from over 3 hours away to the hospital in my city to turn the ICD off until it could be replaced. The cardiologist simply told these ER doctors to tape the magnets to my chest above my ICD & it would stop shocking. It was done, it stopped shocking, the tech came in from medtronics to turn it off after one more shock, battery alarm was going off all night but my cardiologist arrive the next day to do emergency surgery to replace the ICD with a new one (different brand), cap the frayed lead, and insert a new lead and now it is working great for the past 5 years. I am thankful that at least the patient Brooke that posted above was able to get hers turned off it sounds like before it did start shocking because that is the worse thing in the world. It kept sending my heart in a very abnormal rhythm that was already damaged from an MI in Nov of 1998 where I had major heart failure at age 35. There are all kinds of stories like mine and even worse in many cases as some are far much worse and then some that are not near as bad at this point. I would also ask and say to Bob that please don’t give up on the post and if you feel like you just have to quit posting if there would be any way I could exchange information with you I would be happy to do it outside of this forum to stay in touch.
    In summary I want to say thank you for the forum Tom Lamb as this has been very insightful and helpful. It is just like any other forum or web site in my opinion though that is out on the internet. I believe we all should read the information posted and make a judgment or decision on our own about how much weight or truth we take from any post. Many reasons for many posts and many posts are posted for reasons that have to be really looked at and taken into consideration based on maybe other research you need to do to validate the source or possibilities as it relates to your own need. I know many people are very frustrated about this settlement, about attorneys, and many other things going on in life related to the recall by medtronics. I am not saying that they are right or wrong it just has to be taken into consideration in my book as to the reason of the post sometimes. I honestly don’t believe anyone 100% knows what the time frame is going to be in the end or the final amounts, or any real details relating to the settlement. The reason I believe this is because A) this type settlement is really the first of this nature (correct me if I am wrong here because I could be wrong) but the first where the courts ruled that Medtronics really didn’t owe anyone B)there are many people working on the process and they are having to in some way build the process as they work through the details with nothing really to use as a guide. I could be completely wrong about these statements above and yes in the end it might not be near enough for someone that lost someone or not even close to enough to take care of someone that is now much worse off then before they had the ICD but no amount of money will ever make that right in my heart nor even in my situation. I just say that to say that its at least something and more then the courts had required the company to have to pay.
    My final thought and really my main reason for my post was this…
    I know in all my paperwork that I signed I did sign a confidentiality agreement that requires me to keep silent about any of the facts or really any information that I get in reading any of my documents from the courts, lawyers, or medtronics about the case and settlement. It states that since this is a class action settlement (btw I talked to my attorney before posting anything here and it is not a settlement to a suit) as they are admitting no wrong doing or guilt and honestly medtronics doesn’t have to pay anything if they don’t want to pay anything in this settlement. I have an opinion on that but will not share at this time. It CLEARLY states that revealing any type of information about the settlement or details about the settlement could in layman’s terms “cause everyone to not get any thing at all at this point.”
    That being said please be very careful about the details of any amounts, numbers, dates, etc. unless you know or have spoken to your attorney about talking or revealing this information to anyone. I first off would HATE to think that all the people that might get some kind of settlement which need it could end up not getting anything at all would be worse. I would also hate to see someone in this post that is trying to help out others end up becoming the victim and subject of possible litigation for violating a confidentiality agreement. Please just take that into consideration as I am not an attorney so please don’t take this as legal advice or use this as documentation of the details or facts surrounding the Medtronics Sprint Fidelis pending settlement. I am in no way revealing the details or facts regarding the case outside of what is public information or knowledge that is on public record with the courts.
    Like I always say to anyone that is waiting and hoping for something good to happen…”don’t give up five minutes before the miracle!”

    I first want to think anonymous for being a voice of reason. I was very upset about some of the things being posted and I guess I got caught up in all the turmoil going on. I know that my attorney is giving me all the information they can and they have been very caring and informative. Some people are always going to be negative about life in general and I need to “get over their non-sense”. We all knew what we signed and those that did not, took a big chance.

    Tom, Just a quick note. The suit has not yet been funded. It seems they are waiting on the Minnesota Court to disband the MDL. The request to do so has been in since June 10th. So it looks like the Courts are doing what they do best, slow everything down.

    Received notification from my attorney for some outside firm to deal with medicare, VA and private insurance. They will act on your behalf for $200. If you do not want them to act on your behalf, then you are responsible for dealing with your insurance provider who might not give you a good deal. Sound like a scare tactic

    Good afternoon. I did receive a settlement note stating that the 268 million has been reduce due to the fact that there are only 8,100 cases submitted. Second it is true metronic has not released the settlement money as of today. Third there is no conmfirmation of settlement amount for the individual cases as of today stay tune.

    I called my lawyer to find out if the Medtronic settlement checks have been mailed. She said no, but she found out there is 6,ooo cases to be paid. So I guess that means almost 2000 people that submitted claims arn’t getting anything. So I am not counting my money before I get it!

    I just found this site by googling to see if I could find any information regarding the settlement. I am so glad I did. This has been very informative. My father was shocked “95 – 98” times, Yes that is correct between 95 and 98 times before a magnet was placed on his chest to stop it. It had started shocking him while he was at home one morning and 911 was called and he was carried to a local hospital and they did not know what to do, they let him lay there with a monitor on telling us that they did not think that he was having a heart attack, while all along this 70 something year old man was screaming in pain everytime it went off. He was then transported to a larger hosptial 50 miles away, by ambulance at 95 mph, while constantly being shocked. They rolled him into the ER and thank God someone there walked up and laid a magnet on his chest. I cannot help but cry while typing this when I think of the pain my father was in. He was practically begging God to let him die everytime it went off.
    On top of all this he got a staph infection from the Pacemaker/Def when it was first put in. He was in the hospital for a while having to take several drips fighting the infection so his incesion wound would heal up. Then it malfunction as stated above.
    They disconnected the wire, but could not remove it OR the Defibulator because it is way to dangerous due to his health.
    He has suffered with post tramatic stress disorder because of this.
    I could go on and on telling you the horrors that my father has had to deal with. I can hardly believe he is still on his feet and walking this earth after what he has suffered.
    I feel for the families of the patients that have had to go through watching their love ones 1st – deal with the pain and health issues, and 2nd – the stress of medical bills, loss of income because of what they have gone through.
    Someone in congress should be so ashamed at the decisions they have made. I just wonder if they had to watch someone in their family go through something like this that could have been prevented if they would still uphold their decion.

    It appears this whole thing will be coming to an end for most of us within the next 60 days. Only those who don’t agree with the amounts they are getting will carry on. Several of us have been told we should have award letters by mid-Dec and payments by mid-Jan. I know its been a long difficult struggle, hopefully it will end with little fireworks. Good Luck to all

    Tom, It looks like this thing is ending. My attorneys office said award letters were mailed Friday. They wouldn’t tell me the amount, and its something I couldn’t share if I had it. Don’t think it’s anywhere close to what we thought it would be. Payments are scheduled to go out in Jan. 2012. Thanks for all your support.

    I received a award letter from my lawyer and I must say that I am disappoint with the amount of my award I was told that I would get up to 35,000. Well that is not true. I am receiving less than half of that amount. Thats after being shocked a number of times and being in the hospital for 3 days. and having my lead changed later on in 2010.. This is a disgrace. These lawyer are getting must of the money 49% to be exact. so to all the amount of your award will be less. These lawyers a crocks. I will see if I can get them to reduce the amount that they are taking out since my award is less than 16,000 minus 49%

    I too got my letter today and it is less than I had thought. That is not the bad part and anonymous I understand what you are saying. However with that said, I bet you didn’t talk to your attorney for him to tell you that Judge Rosenbaum is holding back 40% until all the insurance claims are settled. That will be later in the year. So, most of us are getting very little in Jan. I would say somewhere in the range of 2=5 thousand dollars. The attorneys and Medtronic are the ony ones to come out on top. GOD SAVE THE QUEEN, MEDTRONIC CAN’T. Just a little humor, I am not English.

Ok just wanted to clear that up because of what I wanted to share.
    Bob I wish I could get your email address some way as I have always enjoyed your post and thoughts on here for some time now. I believe we are in the same boat buddy! Next…..
    I got a call from my attorney today and before they even told me the amount they were asking for more documentation that I am now frantically trying to get together at this point. (Side thought is that it is funny how the courts took months and months to get this information to us but now they are asking my attorney for this information by the 16th of December?! Right! They say jump…and we have to say…or do we?) I am now faced with a big delima because like you Bob and the other anonymous I was schocked multiple times and damage was done. The amount they offered is VERY low compared to what we were told it would be in the beginning. I have been fighting this deal for years at least since 2008 as my schocks happened only a month after they issued the recall letter in 2007. Really not that how long should matter because 1 single shock that didn’t need to happen is way to many schocks so everyone I feel for you all! I have had an attorney since Aug-2008 “working” for me. Any way the delima! My attorney wants me to appeal mine. There are 3 people out of the approximately 30 he represented that he wants for us to appeal and go for more money. My questions… Is it really going to be worth it? How long is this going to take? What is different about the appeals process that is going to make them change their minds and move me from a Cat 2 to a Cat 3? I along feel that mine was worthy of Cat 3 but maybe not! I asked my attorney these questions and I probably don’t even have to post his response but his response “you know that’s a good question and I am not sure.”
    Any way just thought I would say to everyone that unfortunately no one is getting what they thought they would and certainly not enough…but as I said all along “how much is enough” because no amount of money in my opinion could ever get me to have to go through that again or make it worth what happened to all of us that were shocked. I really feel like we were decieved by Medtronics just to help maybe convince their investors to see that they work with the patients with the defective products when they have defective products and poor design issues. Therefore dear investor see we won’t ever be hit with some big lawsuit that would cost them millions and hurt the bottom line. That is my 2 cents!
    I do wish everyone the best! Don’t give up on hope and keep the fires burning. I do feel blessed to live in a country where we at least have the right to change things that aren’t right and speak our mind! God Bless America!

    Daniel, I don’t know what your amount is but I will tell you that most of the amounts I have heard for tier II has been in the 8-12 thousand dollar range. Tier III 35 and up.
    I was shocked 6 times, and lucky the Para knew how to turn the damn thing off. My wife had a magnet hanging on the fridge door. What made mine tier III was upon replacement I had a blood clot form that went into my left arm. I spent 5 days in the hospital, lots of pain in the arm and then had to take Cumin for 8 months. Along with that I had to have my blood checked a minimum of every two weeks and then finally I started and still do, have cramps in my left arm. From my upper arm, elbow and even into my hand. I never had cramps there until this. In my legs, neck and rib cages, but never in my arm. So that is how I wound up in Tier III.

    My mom had the defective lead implanted in 2006. In 2007 her lead fractured causing her to pass out and hit her head. An hour prior to this she was driving her car. She would have most likely killed herself if not others! The doctors said it was a miracle she was alive. With the pictures I took of her injuries and the circumstances I felt she would fall into Tier III…she did not! I am very disappointed in the turnout of this case. Although we are very thankful she is alive today I feel the way it has been handled is very misleading. The settlement letters offered no explanation of how the monies would be dispersed. A senior citizen gets a letter stating one amount only to find out is will be a much smaller amount if any!!! However I am thankful we have her today and no amount of money could take her place!!

    To ML, Sorry about what happened to your mom. There is NOBODY going to win in this settlement. I have yet to hear of one person saying that are pleased with what they got.Its sad, but true. We took to much of the print media (sorry Tom) to heart. Remember the headline all of the press releases said “8100 cases settled, avg settlement 33,000 dollars” First off there were 14777 cases, almost twice as many as reported by whom, I don’t know. But that also reduces the award to about 17000. Go figure, its really not as it originally appeared. We go SMOKED. The bad part is my original letter from my attorney said it expected 15000 people, but I over looked that. I was so excited we were going to get something out of what I expected would be nothing with the Reigel vs Medtronic ruling. Life has a way of not always treating us as we like.

It’s like pulling teeth, trying to talk to this law firm..     Reading all of your comments. I am so sorry to hear of so much misfortune. My Mom, who was shocked 22 times, survived the initial “attack”, but that was,in truth, the day she stopped living. Prior to the shocks she was a vibrant and active woman, who loved nothing more than her children, grand-children and great-grand children. After the shocks, she was fearful of everything … She stopped driving, stopped working and became a recluse. She feared she would be shocked again and hurt herself or someone else. She would never hold her first great-grand-son, because she was afraid she would drop or throw him if shocked again. Sadly, my beautiful and loving Mother died December 19, 2009, but in truth she died in 2004 when a faulty device took away her will to live. I got her award letter today, and feel disappointed that her life and death came are viewed as worth so little.

    These values or amounts take nothing into consideration!!! I am a young man compared to the average pacer recipient, and I am now out of work for the rest of my life because of serious complications during multiple surgeries to correct the MEDTRONIC lead.
    Now that we (Wife, Kids & myself) know that we are going to be loosing the house, maybe one vehicle, life savings etc… I now have to try to find a job that will match my health level … and that is near impossible. My income dropped to less than a 1/8 of what i used to make in the computer world. Kind of like trading your BMW for an 80’s Chevette and trying to drive it the same way. If we all appeal then maybe they might get a hint. OR the lawyers can put all us on the payroll, and then we can get the millions we all deserve.

    It’s all true, to a point, This settllement was a win/win for Medtronic and the lawyers.
    The most galling and disgusting piece of this pie is, the fact the lawyers are recieving their funds from ” both ” the settlement and the client !
    The ” legal ” system is truely a maze that only a select few know how to manipulate.
    The people hurt by this blatant outrage of justice, need a true and powerful victims advocate to undue this disaster of a settlement, brought to us courtesy of the Federal Gov., and the ( beyond reproach ) estimable Judge Kyle and his deep pocketed friends. This advocate, would be hailed as a saviour of sorts. Anyone up to the challenge, the history books could be very kind to you.!

    I signed papers last month to take the offer figured something was better then nothing , who has time to wait 3 more years for them to decide maybe they were wrong.But if you have the energy to fight them I wish you luck if you decide to challenge them, I really don’t think it will make a difference. Some of the stories are horrible, so sorry for all of your pain.

    It is January 14th 2012.. I still havent recieved my father settlement and after calling his attorney on thursday and him biting my head off, after I told him I had read some of these blogs/forms. I had said people started getting their settlements back in Nov.. He told me to “get my facts straight” that no one had recieved a check because each law firm got their checks on Dec 19th.. My father passed away Aug 30th 2011 due to his heart, he had the Sprint Fed lead implanted in 2007 and it shocked him and fractured so it was removed in 2008.. I dont know what the hold up is with getting the settlement but I wish my father would have never used this W*&&^%$& K@#$#@ law firm.. The attorney Im dealing with is completly unprofessional and rude..

    Follow up from the posting of ” in shock and amazement “….A quick brief history of my case , for your comparison to your own case”….
    Four different instances of the device shocking me mumerous times ,once in the doctors own office for for over an hour, ( I actually think I begged the nurse to put me out of my misery at one point. The surgery to have the leads and device removed, and, I’ll leave to your imagination the effect this has had on my life.
    Now, after all of that….would you not agree I would be one of the harmed to a huge degree..????
    For those of you awaiting a settlement, that would justly compensate you, for the harm, let’s just say, after all that, They have decided my price tag is less than 9 thousand dollars. Good luck folks ! My prayers are with you…!
    My faith in our system of justice is shattered by the injustice built into this class action , that benefits only that of the State, and the legal profession.
    It’s shame no one has a better solution to this injustice of back door politics at it.s finest !!!!!!

    my settlement gross was for 20,000 but ended up being 18,816 now the att. fee an lien money has to be held , so I RECEIVED A CHECK FOR 4,758.40 TOLD THEM i wanted to know how much was being held for the lien, an ask when I will get that money as i have no info on an lien against me. got a call back was told a letter will be sent out with a break down. some time this week.I believe they will get more then me. received chek this weel thursday.

    My mom’s settlement was 19,000 of course she has only received a check of $3500.00 today. Does anyone know when the rest of the money will be dispersed? My mom has no liens, bankruptcy etc. Just another excuse to hold money that is due to suffering patients!

    I was forced to settle by my attornies. This thing almost killed me and my doctors put the same lead back in me. I had three operations to repair the damage the lead caused and now I am waiting on the next shock.
    We were sold out. Period. My attornies have gotten more out of this than I will. They still haven’t paid me a dime yet. And Tom is right. There will be NO relief if you get shocked again. Medtronics will pay $1,400 for the lead and thats going to the new leadd you get if you live.
    When this is over I look to recieve $405.00. From top to bottom, attornies, judges and politicans, it was all about protecting Medtronic. Juge Kyle’s son is an attorney for Medtronic. Check that out.

    i to am a person that had a defective lead . i suffered for two years with pain in my left arm. my doctor that implanted the device said i would have to live with the pain. this doctor was in jackson miss. we are misplaced people from hurrican katrina. i was from bay st louis miss. before the storm. i had a major heart attack in 1999. i had the same doctor the whole time. when i m moved to jackson the heart doctor i saw ther thought i might benefit from the device because i also needed back surgery. any way my question to you are anyone else out there that can answer this question. which is why someone like bill mayer or some one else on a fox network does not do a program on this awful thing that the medtronic company is getting away with because of the new law preempted? why the fda approves all the major decisions on our health yet they can not be sued or held accountable for the decisions they make? instead of our goverment helping us the are passing laws to protect big money. how much money was passed under the table for them to let us the little people suffer while the people at the top get rich.i think medtronic be given all their money back and the whole class action suit be dropped. because the people who did the suffering are still left suffering. i do not think the lawyers should profit from our suffering while we get nothing or next to nothing for our suffering.why is nothing being investigatedabout the doctors getting $1000.00 per device he implanted in people. or judge ritchard kyle s son was an attorney for medtronic? how many people actually know what their attorneys did for them over all this coffee and tea?i was always told as a child growing up HE WHO HAS THE GOLD MAKES THE RULES! medtronic must have the gold besause the bought everybody but us.

    I rec’d a partial check in Jan.they are still holding 40% not sure how much that is.they told me I would get it in 4 months now it is just the waiting game.Seems you should have got something by now.You can bet none of us are getting what we shold have received.     After almost six years and interviews with two Medtronic’s reps, both who told me to expect having problems with leads after about five years, I’m at wit’s end. . . expecting shocks at any moment. The doctors who implanted the device treat it as if it was a joke, have even denied that there even was a recall. They refuse to refer me to a different doctor and have denied me a round magnet to use in the event that errant shocks occur. They say that I’m too DUMB to take it out of my pocket and place it over the device. (That’s a whole different story.) Did I mention that a major airline hired me to transition experienced airline pilots to flying one of the world’s most sophisticated airliners, including emergency procedures?
    After five years of anguish shared by my family, especially my young son, Medtronics offered me less than $360.00 for a settlement.
    Of course I didn’t accept it as it was to be “confidential.” My little bit of business for the chaotic HAVI North and Medtronics won’t affect them, but my advertising might.

    Tom,
    I wanted to post on final update or what I hope to be one final update.
    First of all I am the anonymous 1 that posted on Aug. 23, 2011 & on Nov 1 with information on where to find court information. Then the last time I posted was on Dec 08, 2011.
    After I posted on Dec 08, 2011 it took NUMEROUS calls to my attorney request them to just please send me a letter about how much money I was going to be even offered. I called even after they had the information on Dec 19th several times asking for the information and they kept telling me that they had hired an “ETHICS” attorney to tell them how do disburse the check they were getting just a few days after they got the letter on the 19th and first payment which was the one that was a total of 50% less (40% hold back & approximately 10% for the fees that they paid the attorneys or people that worked on these cases I think was the what the other 10% was that was taken out of my payment.) Once I got the letter they told me that it would be a few weeks before they could disburse the funds to me because they had to put in their Holding account first to clear then they would have to meet with this ethics attorney because there was confusion on how the funds were to be disbursed. I fired back a certified letter followed by phone calls with demands to get a copy of my case and all correspondance and asked for meeting in person with my attorney. I was fortunate that I know a local judge here and asked them to look at this and find out something about if this was write in my personal situation. She told me that it wasn’t write ethically but legally he could take these actions based on my contract. Once he found out that I was working with a local judge that he knew and might have to go up against in court one day he sent me my file because he was also asking me to sign this lien investigation letter or my funds would not be disbursed. NOw that was wrong I was not required to sign any letter and he could not hold my funds as the judges letter was very clear on how to disburse the funds and that since I was only 43 when it happened that my insurance company was self insured and only had a large health insurance carrier process the claims. Therefore Medicare/Medicaid had no claim to my settlement since they were not involved and I had a letter from the attorney saying the self insured company & provider/processor of claims had been investigated and signed a release that there were no further liens done in the research done on my case. Meaning that there was no need to even sign this letter about signing up for this firm to negotiate with any insurance company on my behalf. MAINLY I told my attorney that I didn’t want anyone from their firm negotiating anything further for me as I had seen what a fantastic job (NOT!) they had done in their negotiations. This went on for over a month with them hold up my first payment. I finally told them I was coming down with my father and another attorney to pick up my check on this set date less the attorney complete fees that I agreed too and a letter signed to remove my attorney from the case. They kept giving me the run around up to that point on the phone about no one was there to sign the check. My final statement was that I was not “ethics expert” but I knew it was unethical for them to hold “MY” money. These lawyers don’t realize that NONE Of this money is their money they have been hired by all the victims to represent us in this matter and we are paying them to do this job for us and has nothing to do with this being their money. Thats when I said no excuses that I would be down at 8 am with my entourage of legal backing in tow to get my check. I had a response within an hour saying that the check was being fed expressed to my home the next morning with a copy of the check and fed express tracking number and no need to come to the office. In the packet was a release too that would release them from my case that I signed and had notorized and sent back releasing him from attorney on the case. I am not pro-se with the firm in Minnisota which I also had spoken with prior to all this and found out that my attorney was not telling me the truth on several issues as far as they were concerned they had told me that on or about the first week in Jan that there was no reason why I should not have a check in my hands less the attorney’s fees and hold back money that was still in Minnisota with their firm. I got the first payment.
    Now today…
    I work directly with the firm in Minnisota that is working on getting the hold back money out to everyone. I have been very pleased with them as they have always been very helpful and not always give me the answer I want to hear but at least truthful to me up to this point. Here is the latest from them as I called them on Monday. They told me that if I didn’t have any medicare or medicaid liens/claims & no private insurance company liens/claims which I don’t then I would be getting the rest of my settlement either next week or the week after as that check has been cleared to be disbursed and sent to me as soon as accounting can get the check processed. I have waited this long so what is two more weeks. Now I am not going to hold my breath on this one but they have been honest with me to this point and always answered my questions and I have been sent all the doucmentation that all the attorneys have been sent regarding updates on the case. It has worked so much better and had I known I would have been pro-se from the beginning & woulod have the 40% that my attorney took out of the first payment which was SO wrong! They should be the last one to get paid. However it goes there are many other things that are worse then the attorneys taking money from inocent victims like the family memebers that have lost their loved ones. I hurt for them so very badly. I wish there was something that I could do to help them so please post something on here if you found something that a person that was shocked over 25 times and survived the shocks can do to help you and I will do ANYTHING and EVERYTHING that I can once I get my settlement from the company. Please understand that I am not trying to be greedy on this because the little bit that I have gotten so far is going for my kids education and to help them out as I really feel like the ones that have been suffering through this just as much as I have suffered due to many reasons. I have to take care of them first as a father but then I will do whatever I can to help others talk with people or write letters as needed within the limits of the law to help you tell your story and my story first hand. I ask nothing in return please but rather I want to be of assistance to others if possible to help them in a positive and ethical way to get some sort of recourse to help them if needed. I will work on getting a site up in the next several months up to help if possilble. It is not going to be some kind of slander and nasty point finger blaming bicker site, I would rather have it be a way to be an outlet for those that need helpo to get help if needed through the support of agencies or others that want to help the cause of doing what is right to help others that first of all have lost a loved one, second of all who have now some kind of disabililty because of the shocks, third a mental or emotional help for those of us who might still need support for whatever reason from this tragedy. You can attract more bees I believe or something like that with honey then vinegar…not sure of how that saying goes but essentially I just want to see what we can do in a positive way to help. It may be slammed I am sure or blocked maybe by those that are so angry I don’t know and beleive me I understand their anger and hurt. I wish them well as well with their efforts to get help or access to change the laws and bring others to justice. I just want to try maybe another approach as well to help others and support the cause with information on where you can go or what you can do to get things accomplished based on others that have had any kind of success in the process.
    I wish everyone the best and I hope they are able to get the ones that are waiting on the lien process to be over done as soon as possible so you can get the rest of your settlement. I would suggest that if you have already got your first payment and your attorney has all the money he/she is going to get as they took it out of your first payment to be maybe see if you can ask them if they would be willing to remove themselves from the case at this point so that the check can be mailed directly to you just like mine is going to be done at this point. You have the right at least in Texas I know to hire and dismiss your attorney from the case. I have to put this disclaimer here as well that I am in no way an attorney and I am not giving legal advice but rather I am telling you the facts based on my case. Please talk with your attorney if you have one to get the information that you need but even more important if you are suffering still or worrying about your Medtronic Sprint Fidelis Leads please call your doctor (if you don’t have one or have not been in a while please get one today) and even more important go see them immediately and make sure to tell them that if it starts shocking that a magnet will stop the shocking if needed. Again let the doctor decide this for you as I am not a doctor either but please seek out medical attention as soon as possible. We need to be advocates in this area so that no more people that still have the leads will possibly end up dying or being hurt like many of us sere by this device.
    I wish everyone the best and again hope you get your settlement no matter the amount as soon as possible and then work on helping others as I know it will be a rewarding thing for you possibly to be able to help others to not go through what your loved one suffered through and didn’t make it before the final pay out.

    I am not sure if it did. She had a heart attack(heart failure) and died from that. About two years ago the thing defibbed her all day into the night, it defibbed her about 12 or 13 times, shocked her that is. Had to call the ER squad to take her to the hospital and they pumped her up with Amioderone(SP?)
    IV until it stopped. I am sure that weakened her already weak heart. She thought it was going to kill her and so did I. She was never the same after that happened. They said the defective lead did not cause this but I am not sure about this, I don`t think they would admit to it. Sent all this into the attorney but I do not think they even got her medical records from this.

    Don’t give up hope yet. Don Alexander obviously has been doing a lot of homework on how we can all get what we deserve. If he pulls it off, we will all owe him so much. From my dealings with him, he is a fine man, not to mention brilliant. When we entered as co-plaintiffs in his lawsuit and he realized it would cost us too much to proceed further with the lawsuit, even after all the money he had spent personally on our behalf, he sent us back our $500 that we had sent him to represent us.     of my education and writing style. The primary purpose of my new book (The Medtronic Murders) will be to raise money
    for depositions, subpoena expenses, travel and hotel, etc. connected with my suits against Medtronic and Boone Hospital
    Center. I will have the book completed by mid-October 2012 considering that I have already done five years of research
    and have already finished a preliminary draft of deposition questions, discovery requests, requests for admissions, witness
    list, opening statement and closing argument. In addition, I have preliminary drafts of the full range of legal pleadings which I

    and requests for admissions……including actual discovery questions and questions for witnesses during trial). The plan will also
    present a draft of opening statement and closing argument along with anticipated cross examination and rebuttal questions and

    brotherhood” wherein the poor and unconnected cannot afford legal counsel and judges are beholden to the lawyers

    of Medtronic victims pertaining to class action settlements and will present evidence that federal judges Richard K. Kyle
    and Nanette Laughrey are guilty of gross malfeasance and should be removed from the federal bench.

    release on the book, my book signing appearances, my TV advertising, etc. I am sure that total book sales will at
    least approach 50% of Medtronic’s victims (except those murdered). I will borrow the necessary money from my son
    (Dr. Blake Alexander) and my brother (Robert Alexander — retired St. Louis Police Detective) to fund my advertising of
    “The Medtronic Murders” prior to hiring my own attorney on an hourly rate. I have $60,000 available now.
    This is round two of hardball forced on me against my will by moronic attorneys who are ripping off their clients big time
    and by political scalawags wrapped in judicial robes. Rounds three and four are in the planning stages. I will convert this email
    into a letter addressed to the CEO’s at Medtronic and Boone Hospital Center. Thereby, no one can claim that they were not

    Hey!!! All you Medtronic victims………….
    For all those Medtronic victims injured by a Medtronic defibrillator containing a recalled Sprint Fidelis lead or a recalled CHI 4420L battery, it has become possible to sue Medtronic in the Circuit Court of each victim’s county of residence. Any previous settlement agreement with Medtronic pursuant to a class action suit or pursuant to a MDL settlement (such as the one before Judge Kyle in Minnesota) will not bar a state suit filed against Medtronic based upon criminal bribery, criminal conspiracies and criminal consumer fraud for four reasons: (1) the prior settlement agreements were based entirely upon product liability legal theories of recovery of damages and not upon injuries suffered as the direct result of criminal bribery of physicians, criminal conspiracies between the party offering the bribe (Medtronic) and the individuals agreeing to accept the bribes (implanting physicians and hospitals acting in complicity with the bribed physicians) in exchange for defrauding heart patients into accepting implantation with a cardiac device known within the medical communities to be potentially defective, extremely dangerous and fatal to a predictable percentage of those implanted with the faulty defibrillators; and (2) the product settlement agreements specifically stated that the settlement pertained to product liability claims under product liability laws pertaining to the manufacturer (Medtronic); and (3) the criminal bribery, criminal conspiracies and criminal consumer fraud were not public knowledge until December 12, 2011 when the United States Department of Justice (USDOJ) announced its findings resulting from a multi-year investigation pertaining to Medtronic’s bribery of implanting physicians. Therefore, the statute of limitations pertaining to state suits filed against Medtronic for intentional torts involving multiple criminal acts (with hospital and physician complicity) did not begin to run until December 12, 2011; and (4) the time window for the relevant statute of limitations is the same time window that applies to the question of “when did Medtronic’s victims have any standing to sue Medtronic for intentional injuries inflicted pursuant to criminal bribery, criminal conspiracies and criminal consumer fraud?” The date of the USDOJ announcement is the same date that answers the question “when did Medtronic become chargeable with the criminal acts that damaged the people filing suit in State courts?” This “chargeable date” is well beyond the date of the above described product liability settlement agreements. Such “later criminal acts” by Medtronic are specifically excluded from the product liability settlement agreements.
    However, it is best to file the state suits immediately because the “intentional torts statute of limitations” varies from state to state ( from one to five years). An intentional tort simply means an intentional wrongful act that causes personal or financial injuries to another individual. The state suits must be filed in the appropriate county circuit courts within the intentional torts statute of limitations that applies to each victim’s state of residence. All of the necessary legal forms and pleadings can simply be downloaded from the website http://www.MedtronicMurders.com after November 1, 2012. The book “The Medtronic Murders” will be published by the website owner (Don Alexander) by November 1, 2012 and available at Amazon.com (go to Amazon.com and in the “books search bar,” enter “The Medtronic Murders by Don Alexander”). The book will pop up and can be purchased by following the prompts for purchase and checkout (after November 1, 2012).

Ijust did an was told I was not on the lien list for medicare now I need to wait for the list for my private insurance Blue Cross bl Shield of Fla. to come in of course they don’t know when that will be most likely another 6 to 8 months.

    People are receiving their 2nd checks, mostly private insurance, at the beginning of October they finished with people who had medicare, I heard of a few who got their checks, strange only $118.00 out for medicare, same amount for a few people. these checks are coming in groups, if you had both medicare and medicaid those will be last from what my lawyer says. around the end of the year! Yea that’s what they said last year. Lets see.

    Just got my letter from the lawyer for my 2nd and last payment. I should get my money in about 10 days. Medicare did take 20% of my gross settlement which was $15,000.00 so they took $3,000.00. Medicaid took 0%. So out of $15,000.00 I got a total of about $5,000.00 everyone else got about $10,000.00. So I’m able to catch up on my bills, thats all I get for all the years of pain an suffering. I guess I’m still alive! Merry Chrismas everyone and take care!

    Wrong, I had all three phases (shocks,replacement and extra ordinary damage. I wish I was awarded $75-85,000. No money yet but I can tell you that I was informed the award is less than half of what you posted, and after the lawyers fees etc., I will only get about 15-20% of my award for damages.The legal system in this country sucks!

Wish I was smart enough to write a letter to a newspaper or Tv news show,or congressman maybe we could shame them into releasing our money.

    I’ve read all the coments and understand as well. But mr lamb while judge rosenblatte or rosenfeld, lockridge, grindal nauen had a wonderful Christmas and holidays I had to answer my 9 grandchildren oldest 8 when they said grandpa don’t be sad next year you’ll be able to get us something. Mr lamb if you could’ve seen the hurt on their faces. And what’s so sad the law firm thinks it’s a joke to say oh next month then 2 months go by then they say oh next month. They think it’s a joke to string us the victims along like this. No wonder people distrust lawyers.

    Daniel, I am hoping that you can help me. My icd was implanted on 7/23/2007 but did not fracture until October 2012. I was wondering if I am entitled to a settlement? Also, I want to say I am so sorry for all the pain and suffering this problem has caused so many people. I am shocked by the way you all have been treated. GOD bless you all.     I am tier three and your estimate of $35,000 and up is too high. I received my award amount and it was less than $35,000. Also, according to my attorney, the 40% they were to receive has been reduced by 9% for the common benefit fund A fee for securing and facilitating the settlement and another reduction of attorney fees by 1% also for securing and facilitation. A rose by any other name is still a rose. meaning that the settlement and facilitation fees seem to be just another attorney charge. This total of 10% along with the 40% subrogation liens (insurance pay back) amounts to 50% of the award being held back by the court. So do the math. If the insurance settlements (subrogation) are not less than the 40% withheld ( I expect them to be less because of the 20% cap),your award will be reduced by the 50% listed above in addition attorney fees are another 31% of the gross settlement plus $200 for those negotiating with the insurance carriers and a small amount for lawyer office expenses. So 81% plus the smaller fees with net you 19% of your gross. Welcome to the U.S. legal system.

    Has anyone else involved in this law suit been informed that their classification has been changed. This from my attorney but I believe the change is in category, not classification which may be one and the same. As usual, this probably means another screwing as I’m sure the classification will be downward and the settlement less. Again has anyone else receive this notification from their attorney?

    July ’13 nearly over and still no word….Back in March, Garretson told me 2 or 3 weeks. In May it was 1st of June. In June the two women handling the cases were no longer employed there. New woman doesn’t like returning phone calls or emails. What gives? This is her latest response (via email auto reply) “I will be out of the office beginning on Tuesday, July 23rd and returning on Wednesday, July 31st.
    For the Sprint program, I will be checking email periodically and responding only to urgent requests. For claimant-specific update inquiries, I will provide response upon my return and no later than Monday, August 5th.”

    I am still waiting the firm of [law firm name omitted by moderator] in new York to call me back every time I call I am told no one available to help me to leave a message . in which I do still waiting 6 months for them to answer one of my calls I have now ask my niece who works for an Attorney. to see if she can find out how to get them to give me my money guess it is time to fight back.

    i wanted to say sorry for all the people thats been shocked for no reason, anyways i live in ohio and found out about the leads, so i go to my cardiologist to do something and get it replaced, he did tell me it would do more damage than good, so i went on with life, well about 2 yrs later i was getting up out of bed and using restroom and the defib shocked me so hard, i could actually feel the wire broke loose, and it did,sister called squad and they sit there and watched me get electrocuted25 times, theygot me too E,R and that think kept shocking me, no doctors didnt know wat to do, so they let it kept shocking me, it hit me over 37 times until i wore the battery down and lost all life, they beat me and did cpr and everything, they finally after 3 min flat lined they used amiomodarone and brought me back to life, this thing did not feel like a horse kicking me , i felt like i was in the electric chair, after getting another one put in ,i asked if there was anything i could do, cause now a person thats never had anxiety or nothing, its ruined my life, i worked const all my life high work with no anxiety , this sucks cant do nothing since they settled, unless someone knows something i dont,but good luck to all the peple that still has it in them, hope nobody exsperience wat ive been through,, OHIO

    angel sorry for your exsperience with the icd, if you hear of anything , could you say something on here, i was shocked 37 times , wore the battery down and died, but brought back to life, good lord looking after me,its a shame all the comments that these people went threw and the lawyers and medtronic got rich, ive havent been the same after all this, it weakened my heart muscle alot, and now i have a-fib, that i never had, cause shockes made my heart too weak, but hope all is well and god bless everyone

    I had the wires break and my defibrillator went off 31 times before I got to the hospital by ambulance and they shut it off it went off in the shower and shot blue sparks out of my chest I still have problems with showering my whole life has been turned upside down I can’t sleep right I don’t eat right I basically am a hermit staying in my house and not going out unless I have to I hope those big buck high powered lawyers for Medtronic are living the good life with no concern for the people who have been wrong by this product not really I hope they suffer like me and burn in hell where is the justice ????????????????????there is none.

    And it goes on…I was shocked 12 times in 20 minutes. fortunately the emt had the right ER doctor and the magnet was put on my ICD, so the shock stopped.
    I never received anything about a recall or lawsuit, nada, zilch. Yet I receive recalls about my car, my truck, and everything else that may affect my life.
    On Dec 30 my ICD will be replaced, along with the cracked Sprint Fidelis lead. How long until the PTSD goes away? Never? Will the ICD/leads be replaced by ANYTHING that comes from Medtronics? Ahh, nope.

    What is medicare or tricare doing about getting their medical payments back for inserting faulty wires and them having them replaced
    I am a class III patient and hope some funds have been set aside for those who were not in the initial class action suit.
    My concern is medtronic notified patients via a letter dated Oct 2007, May 9 2008, and in March 2009. I also understand that physicians were notified in Oct 2007, May 2008 Mar 2009 and Apri8l 2011. I did not receive any letter or notifications from Medtronic, the initial cardiologist my current cardiologist or the medtronic technicians who checked my device every 3-4 months.

    Ok, Had My 1st medtronic lead in neck implanted in 2006. Had my 2nd implant from Boston P. for a double lead going to lower back also.
    So it was connected into original Medtronic lead into neck area. Boston didn’t touch neck wires. Now, neck wires are broke. I’ve been shocked 2x so violently it was like a heart attack. I couldn’t move to turn off. Room mate had to find and turn off.
    What’s a girl to do? I have no energy, tired and tired of this pain. Are you all telling me it’s to late and to bad so sad for me to get into any class action? Please feel free on giving me some information. Thanks, D

    hello all. I had sprint fidelis lead too, but was not part of the class action lawsuit. However, in 2013 my lead broke the Lead Integrity Alert System within my device had not been programmed appropriately, so I was not warned by an alarm that my lead had fractured. This resulted in 12 unnecessary shocks. I have may phone calls to Medtronic and doctor appointments documented in how they handled this which was very poorly. So, if you know of anyone that has this occur to them following 2013 please have them contact me at maddytormoen@msn.com or call 719 963-1737 as I think I can be of help if they decide to file a lawsuit.     2016 May 29….case is dragging on even longer. Maybe it was ’12 when i got a portion of settlement a mere 1800 and a year after a bit more…all told around 5k
    About three weeks ago today (yes 2016) get a letter from my Texas lawyers saying lead council found more $$$…
    Much to my amazement considering the time frame…damn well over 10 years.
    But whats not amazing the dribs of the new 2500 still need to be dolled out.
    Ha remember attorney fees werent paid on the new found money, nor were insurance settlements….
    So here we go again….lawyers say pretty please to accept knowing their cut will come first, then fees for those adjusters (400 first go around then insurance got their cut) and pray tell what insurance folks will get this time…for what its worth, lawyer told me insurance can only go after funds involved in the lead itself (seems they settled that 1st go round)
    Oh well Ive rambled on and the only good is that last year every thing manufactured by Medtronic is out of my body….
    Please St Jude dont fail me now!

    MY FATHER WAITED FOR YEARS FOR THE SETTLEMENT, THEY WAITED LONG ENOUGH FOR THE PATIENTS TO DIE. MY FATHER PASSED 3YRS AGO, WAITED FOR THE ATTORNEYS TO DO SOMETHING. I AM BEYOND PISSED OFF. THAT DEVICE GAVE HIM HELL. AND IN THE END IT DIDNT DO A DAMN THING. HIS HEART STOPPED.
    I AM PUSHING FORWARD WITH THIS LAWSUIT, AND MAKING NOISE FOR ALL THE PAITIENTS WHO NO LONGER CAN;AND FIGHT THIS COMPANY AS LONG AS IT TAKES. THEY HAVE NO IDEA WHAT THE SUFFERING WAS ON THE OTHER SIDE. I HOPE MANY OF YOU ARE DOING FINE! THANKS FOR GIVING ME THE SPACE TO RANT!!

    Had serious surgery to remove the defective leads at Sarasota Memorial
    hospital I was repaid out of pocket expenses under warranty, There is no justice
    I hope the retired judge gets on Icd just like mine.My mental anguish was then
    justified Hey Bob you can’t tell me $#!& !!

    Well I have a question I was also told my my lawyer which Medtronic made me get. I did receive a (good faith payment of 33k that did not cover my 101k medical bills) but I also a year later received 2k. An now my layer says they are sending anther. 2k. So my question is. Is anybody else receiving this money in 2019. An if so I want to know if your payment is inline with what I’m receiving??? I don’t trust my attorney he always rushing me an never has any document to show me from Medtronic.

    I was shocked 9 times. I was dead for 90seconds reported by my diffibulator. I only received 33k. My medical bills over 100 k were not paid. Now they sending my 2k. Anybody else getting this sad excuse of a good faith payment.

    I have been told I was getting a final settlement sometime this year from a letter dated in Nov. Haven’t received a follow up even tho I submitted requested paperwork immediately. No Idea how much money they are talking.

    Just thought I’d say a few things about Medtronic’s. On July 31st 2018 I had a SureScan device and leads (icd) put in. By November 5th 2018 the device lead fractured shocking me 13 times before they could get a magnet placed over it to temporary turn it off. Since I’ve had the device removed, now I’m having open heart surgery next week to have the lead’s dug out of my heart. Seems all I needed was heart medicine in the first place. Constant pain. No attorney will take my case. Medtronic ruined my life.
