First 2015 Update On Fosamax Femur Fracture Litigation: Not Much New Information To Report Out

With New Jersey State Court Fosamax Lawsuits Now Assigned To Judge Mayer, We Hope These Cases Get Back On Track

UPDATE: On March 22, 2017 the Third Circuit Court of Appeals reversed the dismissal by U.S. District Court Joel Pisano of all the pending federal court Fosamax – femur fracture cases nationwide on federal preemption grounds. The Third Circuit significantly held that the ultimate question of whether the FDA would have rejected a Fosamax label change by Merck for the increased risk of femur fractures is a question of fact for the jury, rather than for the court, to decide.

In our last update, “December 2014 Fosamax – Femur Fracture Litigation Update: In The Fosamax Federal Court MDL There Are Dismissals, Appeals, And Court-Ordered Mediations”, we only mentioned in passing the New Jersey state court Fosamax femur fracture litigation.

Even though there is little new information about those cases, this is where we begin in our first Fosamax update for 2015.

From Merck’s Form 10-K Annual Report For the Fiscal Year Ended December 31, 2014 we get this information about the femur fracture aspect of the Fosamax products liability litigation (at pp. 110-111 of the PDF document):

As of December 31, 2014, approximately 3,005 cases alleging Femur Fractures have been filed in New Jersey state court and are pending before Judge Jessica Mayer in Middlesex County. The parties selected an initial group of 30 cases to be reviewed through fact discovery. Two additional groups of 50 cases each to be reviewed through fact discovery were selected in November 2013 and March 2014, respectively.

The current number of these Fosamax lawsuits means there were about 85 femur fracture cases filed from the end of September 2014 to end of December 2014.

Meanwhile, over at the New Jersey Courts website for the Fosamax Multicounty Litigation (accessed 3/2/15) we see some rather disappointing status information: “At this time, there are no events scheduled.” 

Going back to the Merck Annual Report for 2015, we get these three additional facts from the drug company:

  • As of December 31, 2014, approximately 515 cases alleging Femur Fractures have been filed in California state court.
  • Additionally, there are four Femur Fracture cases pending in other state courts.
  • Discovery is ongoing in the Fosamax Femur Fracture MDL and in state courts where Femur Fracture cases are pending and the Company intends to defend against these lawsuits.

As previewed at the outset, there is not much new to report at the present time.

Hopefully in the coming months there will be some positive developments for women who suffered a Fosamax – femur fracture event and have filed a drug injury lawsuit against Merck.

    I really am confused why people as myself who was on the generic fosamax and suffer atpical femur fracture and have suffer I cant even walk without a walker I was sick for over three years taking the generic fosamax cant make Merch liability for our quality independence suffering we have indure on the their drug.     The Pliva, Inc., et al. v. Mensing case was decided by the Supreme Court of the United States (SCOTUS) on June 23, 2011. Justice Clarence Thomas delivered the opinion of the Court, concluding that federal drug regulations applicable to generic drug manufacturers directly conflict with, and thus pre-empt, state law claims.
    The bottom line is that the US Supreme Court ruled in favor of the generic drug company and against the injured patient such that at the present time any “failure to warn” lawsuit involving a generic drug would be dismissed based on this Mensing case ruling.
    Justice Sonia Sotomayor, in her dissent opinion, did well in pointing out the apparent absurdity of this new Supreme Court ruling about generic drug company lawsuits:
    “As a result of today’s decision, whether a consumer harmed by inadequate warnings can obtain relief turns solely on the happenstance of whether her pharmacist filled her prescription with a brand-name or generic drug. The Court gets one thing right: this outcome ‘makes little sense’.”
    Certainly not fair to people like you, I agree; but it is the current legal situation in the US as regards genric drugs.

    My wife took Fosamax for over 5 years. While standing both of her femur bones fractured, sending her crashing to the ground. After surgery, immense pain, learning to walk again, she is now OK. Who is responsible? My wife just followed doctor’s orders. Did Merck do it’s job?

    If your wife used any brand name Fosamax (or Boniva or Actonel) during the 4-year period leading up to her femur fracture event we may be able to file a drug injury lawsuit against Merck (or the drug companies responsible for Boniva and Actonel).

    I have been informed that my lawyer MitznerLaw has dropped all there clients because they are not willing to spent any more toward the Fosamax law suit. The letter address concern with the count rulings.
    I had spontaneous fracture Of both femur June 1, 2010. One femur broke into several pieces and the other was a compound brake. Neither fracture heal. I currently use a mobile chair

    My sister is in a wheel chair may have to have leg amputated. Bart Durham and Associates are attorneys in Nashville, Tn. I hope she was not on the generic. She has been waiting since 2009 or 2010 for this to settle.

    I live in Brisbane , Australia. I was on Fosamax for 10-12 years and was having leg ache and pain for the last 4 years…
    Nine months ago my left femur fractured and a titanium rod was used to strengthen my leg. Four weeks later my right leg was operated on and titanium inserted from hip to knee. The surgeons and specialists at the hospital have said that it was the overuse of Fosamax that has caused the problems.
    I have spoken to lawyers in Brisbane and they have no lawsuits pending against the makers of Fosamax. Is there any way I can join any of the class actions in the United States or are you bringing any of your lawsuits to Australia.

    We are only representing US citizens is Fosamax lawsuits filed in this country.
    Moreover, we are not accepting any new bisphosphonate – femur fracture cases here, for various reasons.

    Let me understand. My case is not going to be accepted as it happened after May of 2016? So where do I go get justice for my pain and suffering, for the lose of quality of life for 4 months not to mention I’ve been dealing with back pain for 2 years that also may be attributed to these drugs. As I have been limping. No doubt my bones have been weak. I have had chronic back back at times and no orthopedic has found a source of the pain. I am so angry that I took something to help my bones that actually sabotage them.

    My Mom developed osteonecrosis of the jaw after taking Fosamax for many years. I just learned about the possible relation and the litigation against Merck for such a horrible side effect. Her suffering for years is unfathomable. Is there any lawyer taking these cases?

    To start, I understand that osteonecrosis of the jaw (ONJ) can be a severe medical condition, as we handled some of those cases several years back.
    We are not currently handling Fosamax – ONJ cases, and I am not aware of any lawyer who is taking ONJ cases at this time. But that is not to say there might not be some lawyers who are still involved with the earlier litigation against Merck.
