Fall 2016 Update On Fosamax Femur Fracture Lawsuits Is Not Much Different Than What Was Reported A Year Ago

Bottom Line Is That The Fate Of These Lawsuits Against Merck Is In The Hands Of The U.S. Court of Appeals For The Third Circuit

UPDATE: On March 22, 2017 the Third Circuit Court of Appeals reversed the dismissal by U.S. District Court Joel Pisano of all the pending federal court Fosamax – femur fracture cases nationwide on federal preemption grounds. The Third Circuit significantly held that the ultimate question of whether the FDA would have rejected a Fosamax label change by Merck for the increased risk of femur fractures is a question of fact for the jury, rather than for the court, to decide.

Back in June 2015 U.S. District Judge Freda Wolfson of the District of New Jersey dismissed the last remaining cases in the Fosamax – femur fracture federal court MDL. However, those cases — as well as some earlier dismissed Fosamax lawsuits concerning femur fractures — could be reinstated if plaintiffs win an appeal currently pending before the U.S. Court of Appeals for the Third Circuit.

And since that time the federal court Fosamax MDL has been in a “holding pattern” while the parties wait for the appellate court to issue rulings on at least two appeals regarding the Fosamax label, or package insert, information about the femur fracture side effect. And for the New Jersey state court Fosamax litigation, it appears that the presiding judge is content on waiting for the federal appellate court rulings to be issued.

One of the main legal issues in those pending appeals is whether Merck could have strengthened the Fosamax drug label warnings about this apparent femur fracture side effect.

The little bit of “new” information about the Fosamax – femur fracture litigation comes from Merck’s Form 10-Q SEC filing for the quarterly period ended June 30, 2016 (at pages 18-19 of this 55-page PDF document):

As previously disclosed, Merck is a defendant in product liability lawsuits in the United States involving Fosamax (Fosamax Litigation). As of June 30, 2016 , approximately 4,400 cases are filed and pending against Merck in either federal or state court…. [P]laintiffs in approximately 4,380 of these actions generally allege that they sustained femur fractures and/or other bone injuries (Femur Fractures) in association with the use of Fosamax…. [NOTE: This means the total number of pending femur fracture lawsuits filed against Merck is down 25, from 4,405 as of 3/31/16.]

As of June 30, 2016 , approximately 20 cases were pending in the Femur Fracture MDL, excluding the 515 cases dismissed with prejudice on preemption grounds that are pending appeal and the 520 cases dismissed without prejudice that are also pending the aforementioned appeal. [NOTE: These Fosamax MDL case total numbers are the same as they were as of 3/31/16.]

As of June 30, 2016 , approximately 3,020 cases alleging Femur Fractures have been filed in New Jersey state court and are pending before Judge Jessica Mayer in Middlesex County. [NOTE: This total number of New Jersey cases is down 20, from 3,040 as of 3/31/16.]

As of June 30, 2016 , approximately 295 cases alleging Femur Fractures have been filed and are pending in California state court. A petition was filed seeking to coordinate all Femur Fracture cases filed in California state court before a single judge in Orange County, California. . [NOTE: This total number of California cases is down 5, from 300 as of 3/31/16.]

We do not know the disposition of those cases that have gone away, i.e., been dropped by plaintiffs who have given up or settled by Merck (which seems unlikely).

The reality is that this Fosamax – femur fracture status update sounds all too similar to the last one, and the one before that, etc.

    Most of those dropped cases were due to attorneys backing out and dismissing the clients. As one who is with an attorney group–who have maintained very poor communication–I suffered two femur fractures, a broken vertebra (those three events within three months of each other) and five metatarsal fractures…and my life will never be the same. To not even be reimbursed the medical expenses from out-of-pocket bills is criminal. My issue is that I never had Osteoporosis and should never have been scared into taking the drug to “preserve” my activity level as I aged.

    I do believe this proves again how corrupt the legal system is when it comes to big Drug companies and dare I say kickbacks. Fosomax has changed the lives of many women and men NOT in a good way. If the drug developers walked in our shoes— with the constant pain, lost wages, changes in lifestyles—the drug and all like it would be taken off the market.
    We the injured need to have a bright light shown on this case. We need a spokesperson to again show the damage the drug has done and continues to negatively affect lives. Let us tell our stories–Merck w/then be quick enough to want to get us paid off. Some have been waiting decades for a settlement.

    I do believe this proves again how corrupt the legal system is when it comes to big Drug companies and dare I say kickbacks. Fosomax has changed the lives of many women and men NOT in a good way.     And here is some background about why the federal preemption doctrine has been applied to drug injury cases.
    The Pliva, Inc., et al. v. Mensing case was decided by the Supreme Court of the United States (SCOTUS) on June 23, 2011. Justice Clarence Thomas delivered the opinion of the Court, concluding that federal drug regulations applicable to generic drug manufacturers directly conflict with, and thus pre-empt, state law claims (see, in particular, pages 4–14 and 17–20 of this Pliva v.     The bottom line is that the US Supreme Court ruled in favor of the generic drug company and against the injured patient such that at the present time any “failure to warn” lawsuit involving a generic drug would be dismissed based on this Mensing case ruling.
    Justice Sonia Sotomayor, in her dissent opinion, did well in pointing out the apparent absurdity of this new Supreme Court ruling about generic drug company lawsuits:
    “As a result of today’s decision, whether a consumer harmed by inadequate warnings can obtain relief turns solely on the happenstance of whether her pharmacist filled her prescription with a brand-name or generic drug. The Court gets one thing right: this outcome ‘makes little sense’.”

    What about Boniva? I took actonel,but then my doctor switched me to Boniva when it came out, and that is what I continued to take the rest of the time that it was prescibed to me. Since then I have had the femur fracture, with two surgeries to make it heal, then I had a broken toe which broke just walking on it, it just snapped, and then I got a broken wrist. My bone density tests are getting worse all the time,, so it surely didn’t do me any good, and I have told the laywr I have that I think they should go after Boniva. So what is the status of lawsuites against Boniva. My lawyer does'[t write to me much and only says that if he hears of anything, he will let me know. YOu have provided me with much more information that they have. I am one of the cases in California. I took fosamax but was switched to the geeric when it came out. I don’t csre if they were the name brand or generic they failed to put warnings on these meds to let us know!! All I know is that Sally Field was always sending me reminders to take my Boniva on my Boniva day, Hey I even had it et yp for her to call me with a recordig that t6h following day was the day to take my Boniva. I took them from about 2000 to 2011. I broke my femur in May of 2011. I thibk all of us desr=erve to be compensated for what we have gone thru and I for one am not giving up.

    My wife fell and and broke her R femur and found out the L femur was also in great need of rodding and the orthopedic surgeons all said the osteoclasts were Alendronate/Fosamax related. I did some inquiries w/ a couple of law firms and as soon as I mentioned Fosamax, the conversation stopped dead. I figured something was up and your summary apparently is why. I was almost willing to believe Merck was retaining these firms thereby causing a conflict of interest.

    On September 8, 2016 I got up to answer the phone, took a step and my left femur shattered! I had emergency surgery to place a rod in my leg, received blood, and had complications! I spent 12 days in the hospital and an additional two weeks in rehab! Up to that fateful night, I was 100% independent and a healthy 71 year old female! My crime, for 10 years I faithfully took Actonel for osteoporosis ! My surgeon knew immediately that my fracture was caused by Actonel! He was very careful to x-ray both femurs! He informed me that my right femur was also on the verge of fracturing. We could see the line on the x-ray. On November 7, 2016, I underwent preventive surgery on my right leg! The rod in the right leg needed to be stabilized by the use of a metal plate! This plate is by my knee! I am in constant pain! My life and that of my family has been turned up side down!
    Now I see, that the pharmacy companies are apparently walking away from any responsibility for all the women who are suffering from the damage caused by so called ‘medications’!

NO DOCTOR KNEW WHAT MY COMPLAINT WAS RELATED TO IN MEDICINE. WELL, BY 2011, RESEARCHERS DETERMINED THAT BISPHOSPHONATES CAUSED FEMUR FRACTURES IN WOMEN AFTER PROLONGED USE. EXITING A GROCERY STORE IN EARLY 2011, MY LEFT FEMUR BROKE AND DOWN I WENT ON A CONCRETE FLOOR. IN ADDITION TO THE BROKEN FEMUR BONE, I SUFFERED 4 BROKEN BONES ON MY RIGHT WRIST AND 6 RIBS FROM THE FALL. I WAS IN THE HOSPITAL FOR ONE ENTIRE MONTH. I NEVER HAVE BEEN THE SAME. I STILL EXPERIENCE PAIN ON THE RIGHT RODDED FEMUR.

    I had the femur break, and walked around for 4 days in great pain. I couldn’t figure out why, I hadn’t fallen or anything. Spent 5 days in the hospital. I was unemployed and had crappy insurance. My costs were over $150,000 . The surgery left me with one leg 1 1/2 ” shorter. Still have pain. Criminal that the courts allow the drug companies to get by with this while they are making huge profits.

    IT’S A DISGRACE TO PUT MEDICATION ON THE MARKET THAT WILL AND CAN DESTROY THE BODY.
    THIS HAPPENED TO ME IN THE YEAR OF 2011.

    I too have a case pending since 2011 or 2012 foe fractured Left femur that occurred in June of 2009. I fell landing on my right side and fractured my left femur. I was 68 years old and in very good health but had taken Fosamax since 1996 (13)years. I had to be medicated to be put in the ambulance. After arriving to the nearest hospital in Kingman Arizona there were no Ortho Surgeons on duty and therefore I had to be Air-lifted to Sunset Hospital in Las Vegas, Nv. There I had surgery for rod placement and faced 4 months of therapy to walk again. A year later I had to have the rod removed due to the screws starting to poke to the outside of my leg. I am still waiting for the results of this litigation.

    I am waiting as did not the judge know I would not have taken the medicene to vuild up my bones and not to have it break, I laid on Christmas eve in the cold outdoors for over a hour and spent Christmas in the operating room HOW Dumb can one be sorry but thats how I feel.
